3. Final approval of:

a. Morrwoods Ranch, Unit 5 (Pct. #1)

Note: Morrwoods Ranch, Unit 5 consists of 3 lots being a 5.47 acre tract. The Lots will be serviced by a certified public water system and individual private on-site sewage facilities. Comment letters from the utilities have been received. Other pertinent information is on file at the Road Department. This plat meets the requirements for final approval.

b. The Overlook at River Crossing, accept dedication of right-of-way, accept construction bond No. SS6172 as road surety, and grant variance. (Pct. #1)

Note: The Overlook at River Crossing consists of 62 lots being 74.86 acres plus 8.79 acres being dedicated to the Homeowners Association as private right-of-way. The lots will be serviced by a certified public water supply system and individual on-site sewage facilities. Comment letters from the utilities have been received. The Comal Appraisal District has approved the street names. Construction Bond No. SS6172, in the amount of $185.640.00 has been submitted as road surety. Variance is for decorative entrance treatment within proposed private road right-of-way. Other pertinent information is on file at the Road Department. Upon acceptance of the variance, this plat meets the requirements for final approval.

ACTION AGENDA CONTINUED:

5. Rescind action taken by Commissioners Court on September 19, 2002 concerning Clean Air Plan for Comal County and the Early Action Compact Agreement with the Texas Commission on Environmental Quality (TCEQ) and the U.S. Environmental Protection Agency (EPA) for lack of a full court.

No action due to not having a full court. This item will be considered during the 10-3-02 agenda.
