NOTICE OF MEETING

COMMISSIONERS' COURT OF COMAL COUNTY TEXAS

NOTICE is hereby given that a REGULAR meeting of COMMISSIONERS' COURT will be held on Thursday, the 29th day of January, 2004 at 8:15 a.m. in the Commissioners’ Courtroom, 199 Main Plaza, New Braunfels, Texas.

CALL TO ORDER EACH REGULAR SESSION WILL BE OPENED WITH A PRAYER AND PLEDGES TO THE FLAGS-ALL PERSONS IN ATTENDANCE ARE WELCOME AND FREE TO PARTICIPATE OR NOT AT THEIR PERSONAL DISCRETION.

8:15 a.m. ACTION AGENDA: The following subjects will be discussed, considered, and acted upon:

1. Claims

2. Amendment to Plat:

a. Rivermont, Unit No. 3, combining Lots 12 and 13 of Block 13, into Lot 12R. (Pct. #1);

b. Mystic Shores, Unit Eight, combining Lots 908 and 909 into Lot 908R. (Pct. #4).

3. Consider proposed design revisions to the private roads within River Crossing, Unit Five, and take appropriate action. (Pct. #1)

4. Accept extension of road surety, Continuation Certificate of Construction Bond #6190181, for Canham Ranch Subdivision, Unit 1. (Pct. #2)

5. Acknowledge the proper construction of the private roads within The Summit North, Phase 5, and release the associated road surety, Construction #SWIFSU0307120. (Pct. 4)

WORKSHOP AGENDA:

1. Reports from Elected Officials and Staff.

2. Reports from Citizens.

ACTION AGENDA CONTINUED:

The following subjects will be discussed, considered and acted upon:

6. Approve Tax Assessor-Collector’s Monthly Collection Report – December 2003.

7. Discuss and consider waiver of penalties and interest accrued on ad valorem taxes and take appropriate action.

8. Discuss and consider refunds (over $2,500.00) of ad valorem tax overpayments or erroneous payments and authorize the Comal County Tax Assessor-Collector to remit refund payments.

9. Re-appoint members to the Comal County Historical Commission with a term to expire February 2006.

10. Appoint Mr. T.L. Walker as the Comal County representative to the Edwards Aquifer Authority South Central Texas Water Advisory Committee, effective immediately.

11. Approve Federal Equitable Sharing Agreement with the U. S. Department of the Treasury, and authorize County Judge to sign.

12. Approve resolution # 2004-03 to support the City of New Braunfels in the proposed collection of e-waste (electronic waste) to include monitors, CPU’s, peripherals, and TV’s in order to recycle and reclaim scrap materials.

13. Remove from the table of December 30, 2003, and approve line item transfer in District Court from: Visiting Judges to: Non-Capital Equipment for purchase of a new lap-top computer for Judge Steel.

14. Approve budgeted part time employee to full time status, pay-group 8-1, in County Court at Law, with no impact to General Fund Budget.

15. Authorize requesting bids for:

a. Uniforms for the Comal County Sheriff’s office;

b. Fifteen (15) mobile radios and eight (8) portable radios for the Sheriff"s office;

c. Equipment for approximately seventeen (17) 2004 Crown Victorias.

16. EXECUTIVE SESSION as authorized by Government Code Section 551.071 for Consultation with Attorney.

17. If necessary, discuss and take appropriate action on any and all items or matters discussed in

Executive Session.

I received and posted said Notice on the bulletin board at the Southeast entrance of the Old Courthouse located at 100 Main Plaza at a place readily accessible to the general public at all times on the 26th day of January, 2004, at 8:15 a.m. Said Notice remained so posted continuously for at least 72 hours preceding the scheduled time of said Meeting.
