 NOTICE OF MEETING

COMMISSIONERS' COURT OF COMAL COUNTY TEXAS

NOTICE is hereby given that a REGULAR meeting of COMMISSIONERS' COURT will be held on Thursday, the 26th day of February, 2004 at 8:15 a.m. in the Commissioners’ Courtroom, 199 Main Plaza, New Braunfels, Texas.

CALL TO ORDER EACH REGULAR SESSION WILL BE OPENED WITH A PRAYER AND PLEDGES TO THE FLAGS-ALL PERSONS IN ATTENDANCE ARE WELCOME AND FREE TO PARTICIPATE OR NOT AT THEIR PERSONAL DISCRETION.

8:15 a.m. ACTION AGENDA:

The following subjects will be discussed, considered, and acted upon:

1. Approve Claims.

2. Approve Treasurer’s Monthly Investment Report January 31, 2004.

3. Acknowledge the proper construction of the private roads within Stallion Estates, Unit 6, and release associated road surety, construction Bond #SWIFSU0306121. (Pct. #4)

4. Amendment to Plat, Canyon Lake Forest, Unit No. 3, combining Lots 1241 and 1242 into Lot 1241R. (Pct. #1)

5. Review and approve the Water Availability Report for New Braunfels Utilities, within Comal County, Texas.

6. Determine platting requirements for:

(a) A 10 acre tract being out of a 29 acre tract, and described in Document Number 200306019442 of the Comal County Official Public Records. (Pct. #2)

(b) Approximately 17.057 acres of land being out of the Otto V. D. Decker Survey No. 556, Abstract No. 135 and the G.W.T. & P. R. R. Co. Survey No. 875, Abstract No. 721, within Comal County, Texas. (Pct. #1)

7. Final approval of the Peninsula at Mystic Shores, Unit Two. (Pct. #4)

WORKSHOP AGENDA:

1. Reports from Elected Officials and Staff.

2. Reports from Citizens.

3. National Fire Wise presentation from the Texas Forest Service.

4. "Walk Across Texas" Kick-off.

ACTION AGENDA CONTINUED:

The following subjects will be discussed, considered and acted upon:

8. Consider prohibiting outdoor burning Order #106.

9. Approve Comal County Sheriff Office Annual Contact Data Report.

10. Consider and approve a partial release of lien assessment.

11. Ratify County Judges signature on revised Texas Department of Health Bioterrorism Preparedness Contract.

12. Discuss and consider waiver of penalties and interest accrued on ad valorem taxes and take appropriate action.

13. Approve Tax Assessor-Collector’s Monthly collection Report – January 2004.

14. Discuss and consider refunds (over $2,500.00) of ad valorem tax overpayments or erroneous payments and authorize the Comal County Tax Assessor-Collector to remit refund payments.

15. Recognizing the official financial training hours attained by Susan L. Patterson, Comal County Treasurer in compliance with Texas Local Govt. Code Section 83.003.

16. Select members to serve on the Comal County Salary-Grievance Committee.

17. Requesting Bids for:

(a) Comal County Road Department Sedimentation /Filtration Basin within Comal County;

(b) The Sattler Road Drainage Improvements within Comal County, Texas;

(c) One Medium Duty Diesel truck for County Road Department;

(d) Three Medium Duty Diesel Dump Trucks for County Road Department.

18. Open Bids for:

(a) Equipment for approximately seventeen (17) 2004 Crown Victorias for Sheriff’s Office;

(b) Fifteen (15) Mobile radios and eight (8) portable radios for the Sheriffs Office;

(c) Uniforms for the Comal County Sheriff’s Office.

19. EXECUTIVE SESSION as authorized by Government Code Section 551.071 for Consultation with Attorney.

20. If necessary, discuss and take appropriate action on any and all items or matters discussed in Executive Session.

I, the undersigned, Clerk of the Comal County Commissioners’ Court do hereby certify that the above Notice of Meeting of the Comal County Commissioners’ Court is a true and correct copy of said Notice. I received and posted said Notice on the bulletin board at the Southeast entrance of the Old Courthouse located at 100 Main Plaza at a place readily accessible to the general public at all times on the 23rd day of February, 2004, at 8:15 a.m. Said Notice remained so posted continuously for at least 72 hours preceding the scheduled time of said Meeting.
