NOTICE OF MEETING

COMMISSIONERS' COURT OF COMAL COUNTY TEXAS

NOTICE is hereby given that a REGULAR meeting of COMMISSIONERS' COURT will be held on Thursday, the 8th day of APRIL, 2004 at 8:15 a.m. in the Commissioners’ Courtroom, 199 Main Plaza, New Braunfels, Texas.

CALL TO ORDER EACH REGULAR SESSION WILL BE OPENED WITH A PRAYER AND PLEDGES TO THE FLAGS-ALL PERSONS IN ATTENDANCE ARE WELCOME AND FREE TO PARTICIPATE OR NOT AT THEIR PERSONAL DISCRETION.

8:15 a.m. ACTION AGENDA:

The following subjects will be discussed, considered, and acted upon:

1. Approve Claims.

2. Presentation of Certificate of Achievement for Excellence in Financial Reporting Award to Sharon Ferrell, First Assistant in the Auditor’s Office, for Comprehensive Annual Financial Report for Fiscal Year 2002.

3. Recognition of employees for years of service to Comal County.

4. Determine platting requirements for Lot 28, Bear Creek Hills, Unit. Six. (Pct. #1)

5. Public hearing to consider the placement of certain regulatory signs on County roads, and approve placement of said signs. (Pct. #1)

6. Accept the work in River Chase, Units 1, 2, and 3, in accordance with the agreement between Comal County and Southerland Properties, Inc., Harris Road Company, Inc., and Pro-Tech Engineering Group, Inc. (Pct. #4)

7. Consider Resolution 2004-17 in the matter of endorsing the Texas Department of Transportation Texas Mobility Fund Program, and recommend projects, within Comal County, Texas.

8. Accept extension of road construction surety, Construction Bond No. SD0375 and Storm Water Drainage Improvements surety, Construction Bond No. SD0376, for Rayner Ranch, Unit One.(Pct.#4)

9. Final approval of Jethro Lane, accept dedication of right-of-way, and grant variance. (Pct. #2)

WORKSHOP AGENDA:

1. Reports from Elected Officials and Staff.

2. Reports from Citizens.

ACTION AGENDA CONTINUED:

The following subjects will be discussed, considered and acted upon:

10. Discuss and consider appropriate action to be taken regarding Ravenstar.

11. Approve agreement for law enforcement services between Comal County Water Oriented Recreation District and Comal County Sheriff’s Office and authorize County Judge to sign.

12. Discuss and consider appropriate action regarding periodic blockage of traffic on Bunker Street by Union Pacific Railroad.

13. Ratify signature for expenditures of South Texas Regional Advisory Council (STRAC), for Bioterrorism monies to send local public health officials to 2 workshops.

14. Discuss and consider waiver of penalties and interest accrued on ad valorem taxes and take appropriate action.

15. Discuss and consider refunds (over $2,500.00) of ad valorem tax overpayments or erroneous payments and authorize the Comal County Tax Assessor-Collector to remit refund payments.

16. Select a firm to negotiate an agreement for the engineering of the proposed flood retarding structure.

17. Approve a second Hot Check position at pay group 9 to be filled by a current employee who is a pay group 10 because of supervisory duties she will continue to have. Position reverts to a pay group 9 when supervisory duties are eliminated.

18. Select members to serve on the Comal County Salary Grievance Committee.

19. Amend 2004 budget to establish a line in Purchasing for Building Materials and Equipment and fund the line from General Fund Reserves. The capital expenditure line that was used in prior years was eliminated during the 2004 budget process.

20. Approve combining the duties of Clerk 1 (PG5) position and a Victims Assistance Coordinator (PG9) into a single position as a PG8, and line-item transfer in the 2004 budget from: Assistant District Attorneys salaries to: Clerks salaries.

21 Accept payment from Texas Commission on Law Enforcement Officers’ Standards and Education and approve budget amendment to increase the training lines in the Sheriff’s Office, Criminal District Attorney, Constables Pct. #1, #2, #3, and #4.

22. Line-item transfer in the Criminal District Attorney’s 2004 budget from: Assistant District Attorney’s salaries to: Investigator’s salaries to cover additional hours for Hot Check Investigator.

23. Open bids for: Reflectorized Paint/ Stripping for the Comal County Road Department.

24. EXECUTIVE SESSION as authorized by Government Code Section 551.074 for Personnel Matters.

25. If necessary, discuss and take appropriate action on any and all items or matters discussed in Executive Session.

I, the undersigned, Clerk of the Comal County Commissioners’ Court do hereby certify that the above Notice of Meeting of the Comal County Commissioners’ Court is a true and correct copy of said Notice. I received and posted said Notice on the bulletin board at the Southeast entrance of the Old Courthouse located at 100 Main Plaza at a place readily accessible to the general public at all times on the 5th day of April, 2004, at 8:15 a.m. Said Notice remained so posted continuously for at least 72 hours preceding the scheduled time of said Meeting.
