COMMISSIONERS COURT OF COMAL COUNTY TEXAS

NOTICE is hereby given that a REGULAR meeting of COMMISSIONERS COURT will be held on Thursday, May 22, 2014 at 8:30 AM in the Commissioners Courtroom, 100 Main Plaza, New Braunfels, Texas.

The following subjects will be discussed, considered, and acted upon:

1. Approve Claims.

2. Discuss and consider approval of Resolution 2014-15 Supporting Efforts for the Preservation of the Bracken Bat Cave and Surrounding Area.

3. Presentation of Certificate of Achievement for Excellence in Financial Reporting to Sharon M. Ferrell, First Assistant County Auditor.

 

WORKSHOP AGENDA:

1. Citizens’ Comments.

2. Presentation of Public Health April 2014 Report

3. Reports by County Staff and Elected Officials on items of Community interest.

ACTION AGENDA CONTINUED:

4. Discuss and consider approval of Treasurer's Monthly Report - April 2014

5. Discuss and consider approval of First Amendment to Agreement Regarding Operation of Comal County Water Control and Improvement District No. 6, and authorize County Judge to sign.

6. Discuss and consider approval of line-item transfers in the 2013 Budget of the General Fund, Road and Bridge Fund, Juvenile Case Manager Fund, Indigent Health Care Fund, Sheriff's Chapter 59 Forfeiture Fund, County Clerk's Records Preservation Fund, County Archives Fund, and Criminal District Attorney's Forfeiture Fund between lines within the respective funds to cover negative line-item balances caused by year-end accruals.

7. Discuss and consider approval of a budget amendment to the 2013 Budgets of the General Fund, Jury Fund, Law Library Fund, Child Safety Fund, District Clerk's Records Preservation Fund, and Vital Records Preservation Fund from their respective fund reserves to cover negative expenditure line balances caused by year-end accruals.

8. Discuss and consider approval of amending the 2014 Budgets of the General Fund, Road and Bridge Fund, Flood Control Fund, Law Library Fund, Sheriff's Chapter 59 Forfeiture Fund, County Clerk's Records Preservation Fund, and Vital Records Preservation Fund to move the money for the remaining 2013 encumbrances forward to 2014 and to move the remaining T.C.L.E.O.S.E. Training funds to 2014 for the Sheriff's office, Constables 1, 3,and 4, and Criminal District Attorney's office which also needs the line amended from the budgeted to the amount to the amount being brought forward.

9. Discuss and consider approval of the 2015 Budget Schedule with budget hearings to beheld July 7 through July 9, 2014.

10. Discuss and consider changing 90-day benefits elimination period to 60-day benefits elimination period for new hires in order to be in compliance with the Affordable Care Act.

11. Discuss and consider approval of letter for the Foreign Trade Zone program to transition to the Alternative Site Framework and authorize County Judge to sign.

12. Discuss and consider approval of Order #340 authorizing a Discretionary Exemption pursuant to the Texas Local Government Code Section 262.024 (a)(7) and record signed statement as to the existence of only one source from Purchasing Director into minutes pursuant to Section 262.024 (c).

13. Discuss and consider approval of the Election Systems & Software, LLC (ES&S)Election Services Agreement Renewal, authorize County Judge to sign, and direct Purchasing Director to issue a blanket purchase order for such services.

 

14. EXECUTIVE SESSIONS:

In accordance with Chapter 551 of the Texas Government Code, Subchapter D, Commissioners Court may convene in a closed session to discuss any of the following items; any final action or vote taken will be in public.

(A) Deliberate and consider the purchase, exchange, lease or value of real property, in accordance with Section 551.072, of the Texas Government Code.

(B) Deliberate issues regarding economic development negotiations in accordance with Section 551.087, of the Texas Government Code.

(C) Deliberate pending/ contemplated litigation, settlement offer(s), and matters concerning privileged and unprivileged client information deemed confidential by Rule 1.05 of the Texas Disciplinary Rules of Professional Conduct in accordance with Section 551.071, of the Texas Government Code.

NOTE: Commissioners Court reserves the right to retire into executive session concerning any of the items listed on this Agenda whenever it is considered necessary and legally justified under the Open Meetings Act (Chapter 551 of the Texas Government Code).
