COMMISSIONERS COURT OF COMAL COUNTY TEXAS

NOTICE is hereby given that a REGULAR meeting of COMMISSIONERS COURT will be held on Thursday, September 18, 2014 at 8:30 AM in the Commissioners Courtroom, 100 Main Plaza, New Braunfels, Texas. You may visit our website at www.co.comal.tx.us for agenda postings. Before each regular session will be an invocation and pledges to the flags. All persons in attendance are invited to participate or not at their own personal discretion.

The following subjects will be discussed, considered, and acted upon:

1. Approve Claims.

2. Proclamation recognizing Mitzie G. Roberts for her 30 years of Federal Civil Service and service to the residents of Comal County.

3. Proclamation recognizing the Fischer Cemetery and its Texas Historical Commission Subject Marker and Dedication.

WORKSHOP AGENDA:

1. Presentation by the Comal County Historical Commission of the Completed Historic Resource Survey of Comal County.

2. Presentation of the Public Health August 2014 Report.

3. Citizens’ Comments.

4. Reports by County Staff and Elected Officials on items of Community interest.

ACTION AGENDA CONTINUED:

4. Discuss and consider approval of the proposed private street name change, from Stacy Way to Red Barn Rd, situated off of FM 1863, east of its intersection with Stahl Ln, within Comal County, Texas. (Pct. 2)

5. Discuss and consider approval of the Amendment to Plat, Mystic Shores, Unit Four, combining Lots 418 and 419, establishing Lot 418R. (Pct. 4)

6. Discuss and consider the Resolutions regarding "Texans Feeding Texans" grant funding for the Texas Department of Agriculture Home-Delivered Meal Grant Program totaling $6,538.75, for the period of September 1, 2014 - August 31, 2015, and authorize County Judge to sign:

A. Resolution 2014-19 certifying that the County has made a Grant to the Comal County Senior Citizen's Foundation, an organization that provides home-delivered meals to home-bound persons in the county who are elderly and/or have disability and certifying that the County has approved the organization's account system or fiscal agent.

B. Resolution 2014- 20 certifying that the County has made a Grant to the Community Council of South Texas, Inc., an organization that provides home-delivered meals to home-bound persons in the county who are elderly and/or have disability and certifying that the County has approved the organization's account system or fiscal agent.

7. Discuss and consider approval of Resolution 2014-21 Relating to Establishing the County's Intention to Reimburse Itself for the Prior Lawful Expenditure of Funds Relating to Constructing Various County Improvements from the Proceeds of Tax-exempt Obligations to be Issued by the County for Authorized Purposes; Authorizing Other Matters Incident and Related Thereto; and Providing an Effective Date.

8. Discuss and consider approval of inmate labor for Friends of the Library, a nonprofit organization that provides a public service to the County.

9. Discuss and consider approval of FY2014 Emergency Management Performance Grant (EMPG) Award 14TX-EMPG-639 between the Department of Emergency Management (TDEM) and Comal County, and authorize County Judge to sign.

10. Discuss and consider approval of a line-item transfer in I.T., FROM: Circuits, TO: Recurring Contracts to move funds to the line from which the circuits are now being paid.

11. Discuss and consider approval of a line-item transfer in Constable, Pct. #2, FROM: Non-Capital Equipment, TO: Capital Equipment, to cover the additional costs of the correct rear lightbar for new vehicle.

12. Discuss and consider approval of a line-item transfer in Constable, Pct. #3, FROM: Capital Equipment, TO: Police Supplies, to cover the costs of 4 coats.

13. EXECUTIVE SESSIONS:

In accordance with Chapter 551 of the Texas Government Code, Subchapter D, Commissioners Court may convene in a closed session to discuss any of the following items; any final action or vote taken will be in public.

(A) Deliberate and consider the purchase, exchange, lease or value of real property, in accordance with Section 551.072, of the Texas Government Code.

(B) Deliberate issues regarding economic development negotiations in accordance with Section 551.087, of the Texas Government Code.

(C) Deliberate pending/ contemplated litigation, settlement offer(s), and matters concerning privileged and unprivileged client information deemed confidential by Rule 1.05 of the Texas Disciplinary Rules of Professional Conduct in accordance with Section 551.071, of the Texas Government Code.

NOTE: Commissioners Court reserves the right to retire into executive session concerning any of the items listed on this Agenda whenever it is considered necessary and legally justified under the Open Meetings Act (Chapter 551 of the Texas Government Code).
