NOTICE OF MEETING

COMMISSIONERS COURT OF COMAL COUNTY TEXAS

NOTICE is hereby given that a REGULAR meeting of COMMISSIONERS COURT will be held on Thursday, September 25, 2014 at 8:30 AM in the Commissioners Courtroom, 100 Main Plaza, New Braunfels, Texas. You may visit our website at www.co.comal.tx.us for agenda postings. Before each regular session will be an invocation and pledges to the flags. All persons in attendance are invited to participate or not at their own personal discretion.

CALL TO ORDER:

8:30 AM ACTION AGENDA:

The following subjects will be discussed, considered, and acted upon:

1. Approve Claims.

2. Proclamations recognizing and honoring Dennis Heitkamp, Dr. Fred Frueholz, and Bill Kolodize as 2014 Living Legends in Comal County.

WORKSHOP AGENDA:

1. Recognition by the Texas Association of Counties Risk Management Pool recognizing Comal County for being a member of the Workers' Compensation program since its conception in 1974, and presentation of a commemorative tablet.

2. Citizens’ Comments.

3. Reports by County Staff and Elected Officials on items of Community interest.

ACTION AGENDA CONTINUED:

3. Discuss and consider approval of Treasurer's Monthly Report - August 2014.

4. Discuss and consider approval of the following Amendments to Plats:

A. Vintage Oaks at the Vineyard, Unit 4, combining Lots 715 and 716, establishing Lot 715R (Pct. 1)

B. Mystic Shores, Unit Seven, combining Lots 750 and 751, establishing Lot 750R (Pct. 4)

5. Discuss and consider approval of Release Agreement between Comal County and John and Patricia Pendergist and authorize County Judge to sign. (Pct. 1)

6. Discuss and consider approval of Order #347 regarding the construction of private improvements in the Comal County public right-of-way.

7. Discuss and consider approval of the Texas Enterprise Zone Annual Report for the period of September 1, 2013 through August 31, 2014, and authorize County Judge to sign.

8. Discuss and consider approval of Agreement for the use and lease of State of Texas Registration and Title System (RTS) Equipment, and authorize County Judge to sign.

9. Discuss and consider approval of TCDRS Plan Agreement for Plan Year 2015, and authorize County Judge to sign.

10. Discuss and consider approval of FY 14 Edward Byrne Memorial Assistance Grant award and special conditions, and authorize County Judge to sign.

11. Discuss and consider approval of Memorandum of Understanding for Information Technology Services between Texas A&M Agrilife Extension and Comal County, and authorize County Judge to sign.

12. Discuss and consider approval of a line-item transfer in the Road and Bridge Fund, FROM: Various lines, TO: Maintenance & Operation - Road Construction & Maintenance, to cover costs for the remainder of the year.

13. EXECUTIVE SESSIONS:

In accordance with Chapter 551 of the Texas Government Code, Subchapter D, Commissioners Court may convene in a closed session to discuss any of the following items; any final action or vote taken will be in public.

(A) Deliberate and consider the purchase, exchange, lease or value of real property, in accordance with Section 551.072, of the Texas Government Code.

(B) Deliberate issues regarding economic development negotiations in accordance with Section 551.087, of the Texas Government Code.

(C) Deliberate pending/ contemplated litigation, settlement offer(s), and matters concerning privileged and unprivileged client information deemed confidential by Rule 1.05 of the Texas Disciplinary Rules of Professional Conduct in accordance with Section 551.071, of the Texas Government Code.

NOTE: Commissioners Court reserves the right to retire into executive session concerning any of the items listed on this Agenda whenever it is considered necessary and legally justified under the Open Meetings Act (Chapter 551 of the Texas Government Code).
