COMMISSIONERS COURT OF COMAL COUNTY TEXAS

NOTICE is hereby given that a REGULAR meeting of COMMISSIONERS COURT will be held on Thursday, October 23, 2014 at 8:30 AM in the Commissioners Courtroom, 100 Main Plaza, New Braunfels, Texas. All persons in attendance are invited to participate or not at their own personal discretion.

2. Discuss and consider acceptance of check donation from Spring Branch Tennis Association in the amount of $5,879.00 to be deposited into line item 010-041-5615. (Pct. 4)

5. Discuss and consider ratifying License Agreement between Comal County and John DeLoach, on FEMA property located at 526 River Cliff, Canyon Lake, Texas 78133.

6. Discuss and consider ratifying License Agreement between Comal County and Canyon Corners Property Owners Association, on FEMA property located at 908 Pecan Street and 958 Pecan Street, Canyon Lake, Texas 78133.

7. Discuss and consider ratifying License Agreement between Comal County and Canyon Lake Horseshoe Falls Estates Property Owners Association, Incorporated, on FEMA property located at 700 Horseshoe Falls Drive, 704 Chestnut Falls, 2743 Edgegrove, 660 Chestnut Falls, 655 Chestnut Falls, 1716 River Oaks Drive, 685 Pecan Falls, 744 Chestnut Falls, 2354 Edgewater Falls, 642 Chestnut Falls, and 2150 Edgewater Falls, Canyon Lake, Texas 78133.

8. Discuss and consider approval of Order #349 By the Commissioners Court of Comal County, Texas Authorizing the Issuance of "Comal County, Texas Tax Notes, Series 2014", Levying an Annual Ad Valorem Tax, Within the Limitations Prescribed by Law, for the Payment of the Notes; Prescribing the Form, Terms, Conditions, and Resolving Other Matters Incident and Related to the Issuance, Sale, and Delivery of the Notes; Authorizing the Execution of a Paying Agent/Registrar Agreement and a Purchase and Investment Letter; Complying with the Requirements of the Depository Trust Company's Letter of Representations; and Providing an Effective Date.

9. Discuss and consider approval of a line-item transfer in the Auditor's office, FROM: Recurring Contracts, TO: Building Maintenance - Repairs: Courthouse & Annex, to replace the carpet in the Auditor's office.

10. Discuss and consider approval of a line-item transfer in County Clerk's Archive Fund, FROM: Data Processing Services, TO: Non-capital Equipment, to cover the cost of computers and other equipment for the implementation of the Fidlar software program.

11. Discuss and consider approval of a line-item transfer in Information Technology, FROM: Software, TO: various lines, to allow procurement of new telephone service and remediate shortfalls in Office Supplies and Long Distance budget lines.

12. Discuss and consider approval of AT&T Network Integration Services and Equipment Agreement(s) utilizing Texas Department of Information Resources Contract DIR-TEX-AN-NG-CTSA-005 and DIR SDD-2258, and authorize County Judge to sign.

13. Discuss and consider approval of Supplemental Agreement to Bid 2013-114 - Traffic Sign Materials for:

A. Osburn Associates, Inc.

B. 3M Company; and authorize Purchasing Director to execute all related documents.

14. Present responses and consider award of Bid 2014-420 - Tennis Court Lighting for Spring Branch Tennis Center, and authorize Purchasing Director to execute all related documents.

15. EXECUTIVE SESSIONS:

In accordance with Chapter 551 of the Texas Government Code, Subchapter D, Commissioners Court may convene in a closed session to discuss any of the following items; any final action or vote taken will be in public.

(A) Deliberate and consider the purchase, exchange, lease or value of real property, in accordance with Section 551.072, of the Texas Government Code.

(B) Deliberate issues regarding economic development negotiations in accordance with Section 551.087, of the Texas Government Code.

(C) Deliberate pending/ contemplated litigation, settlement offer(s), and matters concerning privileged and unprivileged client information deemed confidential by Rule 1.05 of the Texas Disciplinary Rules of Professional Conduct in accordance with Section 551.071, of the Texas Government Code.

NOTE: Commissioners Court reserves the right to retire into executive session concerning any of the items listed on this Agenda whenever it is considered necessary and legally justified under the Open Meetings Act (Chapter 551 of the Texas Government Code).
