COMMISSIONERS COURT OF COMAL COUNTY TEXAS

NOTICE is hereby given that a REGULAR meeting of COMMISSIONERS COURT will be held on Thursday, February 05, 2015 at 8:30 AM in the Commissioners Courtroom, 100 Main Plaza, New Braunfels, Texas. You may visit our website at www.co.comal.tx.us for agenda postings. Before each regular session will be an invocation and pledges to the flags. All persons in attendance are invited to participate or not at their own personal discretion.

The following subjects will be discussed, considered, and acted upon:

1. Approve Claims.

2. Proclamation naming February 2015 as "Teen Dating Violence Awareness Month" in Comal County.

WORKSHOP AGENDA:

1. Presentation of Excellence in Achievement from the Universal Public Procurement Certification Council (UPPCC) for the 2014 Agency Certification Award.

2. Citizens’ Comments.

3. Reports by County Staff and Elected Officials on items of Community interest.

ACTION AGENDA CONTINUED:

3. Discuss and consider approval of the following Amendments to Plats:

a) Canyon Lake Forest, Unit No. 3, combining Lots 1077 and 1078, establishing Lot 1077R (Pct. 1)

b) Vintage Oaks at the Vineyard, Unit 2, combining Lots 490 and 491, establishing Lot 490R (Pct. 1)

4. Discuss and consider approval of a private street name, Gattuso Rd., situated off the west side of Wald Rd., approximately one-quarter mile north of the intersection of Wald Rd. and Altgelt Ln., within Comal County, Texas. (Pct. 3)

5. Discuss and consider approval of Treasurer's Monthly Report for December 2014.

6. Discuss and consider approval of refunds (over $2,500.00) of ad valorem tax overpayments or erroneous payments and authorize the Comal County Tax Assessor-Collector to remit refund payments.

7. Discuss and consider approval of Interlocal Agreement between Comal County, Texas, and Texas Parks and Wildlife, and authorize County Judge to sign.

8. Discuss and consider approval of Order #351 To Abate Nuisance at 398 Glenn Drive.

9. Discuss and consider approval of amending the 2015 General Fund budget, FROM: General Fund Reserves, TO: Administrative Costs - Nuisance Abatement/Hazardous Materials, to cover the cost of demolition and removal of residence at 398 Glenn Drive, Canyon Lake.

10. Discuss and consider approval of budget amendment in the Criminal District Attorney's Office, FROM: General Fund Reserves, TO: Secretaries, to cover the 2014 underpayment of two Victim Assistance Coordinators and appropriate pay for 2015.

11. Discuss and consider approval of a line item transfer in County Court at Law #2, FROM: CCAL #2 Court Administrator salary line, TO: Receptionist salary line, to allow supplemental pay for the Receptionist while performing the court administrator duties for 45 days.

12. Discuss and consider approval of License Agreement #309799 with American Tower Company for Fischer Tower.

13. Discuss and consider approval of Supplemental Agreement to Bid 2014-111 Dense-Graded Hot Mix Asphalt, Type B, Coarse Surface with:

a) Century Asphalt, LTD; and

b) Colorado Materials, LTD; and authorize Purchasing Director to execute all related documents.

14. Discuss and consider approval of Supplemental Agreement to Bid 2014-113 Containerized & Bulk Asphalt Patching Material with Asphalt Patch Enterprises, Inc., and authorize Purchasing Director to execute all related documents.

15. EXECUTIVE SESSIONS:

In accordance with Chapter 551 of the Texas Government Code, Subchapter D, Commissioners Court may convene in a closed session to discuss any of the following items; any final action or vote taken will be in public.

(A) Deliberate and consider the purchase, exchange, lease or value of real property, in accordance with Section 551.072, of the Texas Government Code.

(B) Deliberate issues regarding economic development negotiations in accordance with Section 551.087, of the Texas Government Code.

(C) Deliberate pending/ contemplated litigation, settlement offer(s), and matters concerning privileged and unprivileged client information deemed confidential by Rule 1.05 of the Texas Disciplinary Rules of Professional Conduct in accordance with Section 551.071, of the Texas Government Code.

NOTE: Commissioners Court reserves the right to retire into executive session concerning any of the items listed on this Agenda whenever it is considered necessary and legally justified under the Open Meetings Act (Chapter 551 of the Texas Government Code).
