NOTICE is hereby given that a REGULAR meeting of COMMISSIONERS COURT will be held on Thursday, March 19, 2015 at 8:30 AM in the Commissioners Courtroom, 100 Main Plaza, New Braunfels, Texas. You may visit our website at for agenda postings. Before each regular session will be an invocation and pledges to the flags. All persons in attendance are invited to participate or not at their own personal discretion.



The following subjects will be discussed, considered, and acted upon:

1. Approve Claims.

2. Proclamation recognizing the 170th Anniversary of First Protestant Church.

3. Discuss and consider acceptance of donation check #3669 from Fraternal Order of Eagles New Braunfels Aerie No. 2999 in the amount of $500.00 to be deposited into the Comal County Sheriff's Office Jr. Deputy Academy Camps Donation Line Item # 010-000-2348.

4. Discuss and consider acceptance of check from Texas Comptroller of Public Accounts for 2014 Law Enforcement Officer Standards and Education (LEOSE) account in the amount of $14,354.14 to be deposited in Sheriff's office (TCLOESE Training) line item 017-5842.


1. Retirement Recognition of William R. Poindexter for over twenty-six years of service to the Comal County Sheriff's Office and to the citizens of Comal County.

2. Retirement Recognition of William Roach for over six years of service to Comal County Juvenile Probation and to the citizens of Comal County.

3. Presentation of the Public Health February 2015 Report.

4. Citizens’ Comments. (Citizens’ Comments are limited to three minutes per person. Pursuant to the Texas Open Meetings Act, the Court is limited in its ability to respond to Citizens’ Comments.)

5. Reports by County Staff and Elected Officials on items of Community interest.


5. Discuss and consider approval of the Amendment to Plat, Mountain Springs Ranch, Unit Three, combining Lots 462 and 463, establishing Lot 462R. (Pct. 1)

6. Discuss and consider approval of the following Amendments to Plats:

a. River Chase, Unit Eight, combining Lots 1414 and 1415, establishing Lot 1414R. (Pct. 4)

b. Vacate and Resubdivision Plat of Lot 68B, Emerald Valley Subdivision, combining Lots 68E and 68F, establishing Lot 68ER (Pct. 4)

c. The Summit North, Phase 3, combining Lots 144 and 145, establishing Lot 144R. (Pct. 4)

7. Discuss and consider approval of Tax Assessor-Collector’s Monthly Collection Report – February 2015.

8. Discuss and consider approval of refunds (over $2,500.00) of ad valorem tax overpayments or erroneous payments and authorize the Comal County Tax Assessor-Collector to remit refund payments.

9. Discuss and consider approval of Resolutions authorizing sale of certain properties for less than amount of delinquent taxes owed.

10. Discuss and consider approval of a budget amendment to increase General Fund Revenues for capital contribution from the Comal Appraisal District and amend the Tax Office budget From: General Fund Reserves, TO: Capital Equipment, to cover the cost of a PACs server to be shared by the County and the Appraisal District.

11. Discuss and consider approval of Interlocal Cost Sharing Agreement between Comal County, Texas and City of New Braunfels R Regarding Demand Response Public Transportation Services, and authorize County Judge to sign.

12. Discuss and consider approval of the revised job description of the District Court Coordinator adding the duties of Law Librarian.


In accordance with Chapter 551 of the Texas Government Code, Subchapter D, Commissioners Court may convene in a closed session to discuss any of the following items; any final action or vote taken will be in public.

(A) Deliberate and consider the purchase, exchange, lease or value of real property, in accordance with Section 551.072, of the Texas Government Code.

(B) Deliberate issues regarding economic development negotiations in accordance with Section 551.087, of the Texas Government Code.

(C) Deliberate pending/ contemplated litigation, settlement offer(s), and matters concerning privileged and unprivileged client information deemed confidential by Rule 1.05 of the Texas Disciplinary Rules of Professional Conduct in accordance with Section 551.071, of the Texas Government Code.

NOTE: Commissioners Court reserves the right to retire into executive session concerning any of the items listed on this Agenda whenever it is considered necessary and legally justified under the Open Meetings Act (Chapter 551 of the Texas Government Code).
