COMMISSIONERS COURT OF COMAL COUNTY TEXAS

NOTICE is hereby given that a REGULAR meeting of COMMISSIONERS COURT will be held on Thursday, April 02, 2015 at 8:30 AM in the Commissioners Courtroom, 100 Main Plaza, New Braunfels, Texas. You may visit our website at www.co.comal.tx.us for agenda postings.
Before each regular session will be an invocation and pledges to the flags. All persons in attendance are invited to participate or not at their own personal discretion.

CALL TO ORDER:

The following subjects will be discussed, considered, and acted upon:

1. Approve Claims.

2. Proclamation proclaiming April 7th, 2015 as National Service Recognition Day.

3. Proclamation naming April 2015 as "Child Abuse Prevention Awareness Month" in Comal County.

4. Proclamation naming April 2015 as "Sexual Assault Awareness Month" in Comal County.

WORKSHOP AGENDA:

1. Citizens’ Comments. (Citizens’ Comments are limited to three minutes per person. Pursuant to the Texas Open Meetings Act, the Court is limited in its ability to respond to Citizens’ Comments.)

2. Reports by County Staff and Elected Officials on items of Community interest.

3. Recognition of Comal County for receiving the 2015 Platinum Leadership Circle Award.

ACTION AGENDA CONTINUED:

5. Discuss and consider approval of Treasurer's Monthly Report for February 2015.

6. Discuss and consider final approval of Vintage Oaks at the Vineyard, Unit 9, grant variance request, accept Construction Bond #1112958 as surety for road construction and storm water drainage improvements, and authorize County Judge to sign said variance request and surety bond. (Pct. 1)

7. Discuss and consider approval of the following Amendments to Plats:

a. Clear Water Estates Subdivision, Unit I, combining Lots 64A and 64B, establishing Lot 64AR (Pct. 4)

b. Comal Hills, Unit 2, combining Lots 26, 27, 28, and 29 of Block 7, establishing Lot 26R (Pct. 4)

8. Discuss and consider acknowledgment of the completion of private roads and storm water drainage improvements within Serenity Oaks, Unit Three, and the release of the associated surety, Irrevocable Standby Letter of Credit No. 5552633. (Pct. 4)

9. Discuss and consider approval of Agreement for Law Enforcement Services between Comal County Water Oriented Recreation District and Comal County, Texas on behalf of Constable Precinct 4, and authorize County Judge to sign.

10. Discuss and consider approval of Order #352 Amending the Comal County Fire Code.

11. Discuss and consider approval of a budget amendment in Recycling, FROM: General Fund Reserves, TO: Recycling - Vehicle Maintenance to cover the cost contracting the mulching services while the County's mulching machine is being repaired.

12. Discuss and consider approval of a line-item transfer in Commissioners Court, FROM: Courthouse Tours, TO: Framing, to cover the cost the official photos.

13. Present and award Bid 2015-123 Flexible Base, Type A, Grade 2 and authorize Purchasing Director to execute all related documents.

14. Present and award Bid 2015-430 Cattle Guard Replacements for Rebecca Creek Road and Wegner Road and authorize Purchasing Director to execute all related documents.

15. EXECUTIVE SESSIONS:

In accordance with Chapter 551 of the Texas Government Code, Subchapter D, Commissioners Court may convene in a closed session to discuss any of the following items; any final action or vote taken will be in public.

(A) Deliberate and consider the purchase, exchange, lease or value of real property, in accordance with Section 551.072, of the Texas Government Code.

(B) Deliberate issues regarding economic development negotiations in accordance with Section 551.087, of the Texas Government Code.

(C) Deliberate pending/ contemplated litigation, settlement offer(s), and matters concerning privileged and unprivileged client information deemed confidential by Rule 1.05 of the Texas Disciplinary Rules of Professional Conduct in accordance with Section 551.071, of the Texas Government Code.

NOTE: Commissioners Court reserves the right to retire into executive session concerning any of the items listed on this Agenda whenever it is considered necessary and legally justified under the Open Meetings Act (Chapter 551 of the Texas Government Code).
