COMMISSIONERS COURT OF COMAL COUNTY TEXAS

NOTICE is hereby given that a REGULAR meeting of COMMISSIONERS COURT will be held on Thursday, April 30, 2015 at 8:30 AM in the Commissioners Courtroom, 100 Main Plaza, New Braunfels, Texas. You may visit our website at www.co.comal.tx.us for agenda postings.
Before each regular session will be an invocation and pledges to the flags. All persons in attendance are invited to participate or not at their own personal discretion.

CALL TO ORDER:

The following subjects will be discussed, considered, and acted upon:

1. Approve Claims.

2. Proclamation recognizing the Windwehen House on Bridge Street Historical Marker and dedication.

3. Discuss and consider acceptance of check donations from Bulverde Little League in the amounts of $12,000, $13,500, and $4,800 to be deposited into line item 010-041-5615. (Pct. 4)

4. Discuss and consider acceptance of check donation from Canyon Lake Youth Soccer Club in the amount of $250 to be deposited into line item 010-041-5615. (Pct. 4)

WORKSHOP AGENDA:

1. Retirement Recognition of Martha Joyce for over twenty-four years of service to the Comal County Texas A&M Agrilife Extension Office and to the citizens of Comal County.

2. Retirement Recognition of David Barboza for over fifteen years of service to the Comal County Sheriff's Office and to the citizens of Comal County.

3. Citizens’ Comments. (Citizens’ Comments are limited to three minutes per person. Pursuant to the Texas Open Meetings Act, the Court is limited in its ability to respond to Citizens’ Comments.)

4. Reports by County Staff and Elected Officials on items of Community interest.

ACTION AGENDA CONTINUED:

5. Discuss and consider approval of the Amendment to Plat, Canyon Lake Village West, Unit No. Two, combining Lots 217 and 218, establishing Lot 217R. (Pct. 1)

6. Discuss and consider approval of the Amendment to Plat, Cypress Cove, Section Two, combining Lots 442, 443, and 444, establishing Lot 442R. (Pct. 4)

7. Discuss and consider granting a variance for encroachments into the 6-ft. Comal County Easement on the southeast and southwest sides of Lot 62A and on the northwest side of Lot 63, within Tamarack Shores, Section II. (Pct. 4)

8. Discuss and consider approval of Treasurer's Monthly Report for March 2015.

9. Discuss and consider approval of Fiscal Year 2015 Certified Local Government Grant Contract TX-15-021 between Comal County and the Texas Historical Commission, and authorize County Judge to sign.

10. Discuss and consider approval of Agreement for Law Enforcement Services Between Comal County Water Oriented Recreation District and Comal County, Texas, and authorize County Judge to sign.

11. Discuss and consider approval of Resolution #2015-14 Relating to Establishing the County's Intention to Reimburse Itself for the Prior Lawful Expenditure of Funds Relating to Constructing Various County Improvements from the Proceeds of Tax-Exempt Obligations to be issued by the County for Authorized Purposes; Authorizing Other Matters Incident and Related Thereto; and Providing an Effective Date.

12. Discuss and consider approval of Order #355 - Donating Two Road Closure signs to Canyon Lake Fire/EMS Pursuant to Local Government Code 263.152(4).

13. Discuss and consider approval of following changes to Emergency Service District #4 Board of Commissioners:

a) Accept resignation of Bob Walker; and

b) Appoint Joshua Dean to unexpired seat vacated by Bob Walker.

14. EXECUTIVE SESSIONS:

In accordance with Chapter 551 of the Texas Government Code, Subchapter D, Commissioners Court may convene in a closed session to discuss any of the following items; any final action or vote taken will be in public.

(A) Deliberate and consider the purchase, exchange, lease or value of real property, in accordance with Section 551.072, of the Texas Government Code.

(B) Deliberate issues regarding economic development negotiations in accordance with Section 551.087, of the Texas Government Code.

(C) Deliberate pending/ contemplated litigation, settlement offer(s), and matters concerning privileged and unprivileged client information deemed confidential by Rule 1.05 of the Texas Disciplinary Rules of Professional Conduct in accordance with Section 551.071, of the Texas Government Code.

(D) Deliberate the appointment of Public Information Officer in accordance with Section 551.074, Texas Government Code.

NOTE: Commissioners Court reserves the right to retire into executive session concerning any of the items listed on this Agenda whenever it is considered necessary and legally justified under the Open Meetings Act (Chapter 551 of the Texas Government Code).
