NOTICE is hereby given that a REGULAR meeting of COMMISSIONERS COURT will be held on Thursday, May 21, 2015 at 8:30 AM in the Commissioners Courtroom, 100 Main Plaza, New Braunfels, Texas. You may visit our website at for agenda postings.
Before each regular session will be an invocation and pledges to the flags. All persons in attendance are invited to participate or not at their own personal discretion.



The following subjects will be discussed, considered, and acted upon:

1. Approve Claims.

2. Proclamation naming May 27th, 2015 as "World MS Day" in Comal County.

3. Proclamation recognizing May 2015 as "Older Americans Month".

4. Discuss and consider acceptance of the following donations to the Comal County Sheriff's Office Jr. Deputy Academy Camps to be deposited in line item # 010-000-2348:

a. Check #209 in the amount of $50.00 from William B. Barron and Tracy A. Barron;

b. Check #2866 in the amount of $200.00 from Mark Elder State Farm Agency;

c. Check #1320 in the amount of $200.00 from Kevin Wartsbaugh and Misty Wartsbaugh/Edward Jones;

d. Check #0016058807 in the amount of $200.00 from AAA Auto Club Enterprises;

e. Check #32266 in the amount of $200.00 from Woods Cycle Country LP;

f. Check #1043 in the amount of $1000.00 from V.F.W. Post #7110; and

g. Check # 6004 in the amount of $50.00 from Troy and Dustie Lumpkin.


1. Citizens’ Comments. (Citizens’ Comments are limited to three minutes per person. Pursuant to the Texas Open Meetings Act, the Court is limited in its ability to respond to Citizens’ Comments.)

2. Reports by County Staff and Elected Officials on items of Community interest.

3. Presentation of the Public Health April 2015 Report.


5. Discuss and consider approval of the following Amendments to Plats:

a. Combining Lots 845 and 846 of Canyon Lake Village West, Unit No. 5, establishing Lot 845R (Pct. 1)

b. Combining Lot 1210 of Canyon Lake Hills, Unit No. 2, and Lot 1211R of the Replat of Lots 1211 and 1212 as 1211R, Canyon Lake Hills, Unit No. 2, establishing Lot 1210R (Pct. 1)

6. Discuss and consider accepting Construction Bond No. 0657405 as surety for road construction within Copper Ridge, Phase 4, and authorize County Judge to sign said surety bond. (Pct. 2)

7. Discuss and consider approval of Interlocal Cooperation Agreement by and between the City of Bulverde and Comal County regarding the proposed Bulverde Office Building. (Pct. 2)

8. Discuss and consider acceptance of the dedication of public right-of-way within Lake Ridge at Canyon Lake, Unit Two and acceptance of the road into the Comal County Unit Road System, and release of the associated road surety, Construction Bond #0426479. (Pct. 4)

9. Discuss and consider approval of Treasurer's Monthly Report for April 2015.

10. Discuss and consider approval of Texas Department of State Health Services Contract 2015-003611-00 for Ebola Public Health Preparedness and authorize County Judge to sign.

11. Discuss and consider approval of Order #356 by the Commissioners Court of Comal County, Texas Authorizing the Issuance of "Comal County, Texas Limited Tax Refunding Bonds, Series 2015", Levying an Annual Ad Valorem Tax, Within the Limitations Prescribed by Law, for the Payment of the Bonds; Prescribing the Form, Terms, Conditions, and Resolving Other Matters Incident and Related to the Issuance, Sale, and Delivery of the Bonds, Including the Approval and Distribution of an Official Statement Pertaining Thereto; Authorizing the Execution of a Paying Agent/Registrar Agreement, a Purchase Contract, and an Escrow and Trust Agreement, Complying with the Provisions of the Depository Trust Company's Letter of Representations; Delegating the Authority to Certain Members of the Commissioners Court and County Staff to Execute Certain Documents Relating to the Sale of the Bonds, and Providing and Effective Date.

12. Discuss and consider approval of Assignment and Assumption Agreement to the Project Construction and Use Agreement regarding the Dry Comal Creek Flood Retarding Structure, and authorize County Judge to sign.

13. Discuss and consider approval of Equitable Sharing Agreement for federal forfeiture sharing by the Criminal District Attorney's Office and authorize County Judge to electronically sign.

14. Discuss and consider approval of amendments to the following sections of the Comal County Employee Handbook:

a) Section 4.04 - Sick Leave Benefits;

b) Section 4.10 - Holidays;

c) Section 5.11 - Termination Pay;

d) Section 7.02 - Drug Testing; and

e) Section 8.03 - On the Job Injuries.

15. Discuss and consider approval of the 2016 Budget Schedule with budget hearings to be held July 6 through July 8, 2015.

16. Discuss and consider appointing Carole Foster for a three year term to the Comal County Child Welfare Board.


In accordance with Chapter 551 of the Texas Government Code, Subchapter D, Commissioners Court may convene in a closed session to discuss any of the following items; any final action or vote taken will be in public.

(A) Deliberate and consider the purchase, exchange, lease or value of real property, in accordance with Section 551.072, of the Texas Government Code.

(B) Deliberate issues regarding economic development negotiations in accordance with Section 551.087, of the Texas Government Code.

(C) Deliberate pending/ contemplated litigation, settlement offer(s), and matters concerning privileged and unprivileged client information deemed confidential by Rule 1.05 of the Texas Disciplinary Rules of Professional Conduct in accordance with Section 551.071, of the Texas Government Code.

(D) Deliberate the appointment of Human Resources Director in accordance with Section 551.074, Texas Government Code.

NOTE: Commissioners Court reserves the right to retire into executive session concerning any of the items listed on this Agenda whenever it is considered necessary and legally justified under the Open Meetings Act (Chapter 551 of the Texas Government Code).
