NOTICE is hereby given that a REGULAR meeting of COMMISSIONERS COURT will be held on Thursday, May 28, 2015 at 8:30 AM in the Commissioners Courtroom, 100 Main Plaza, New Braunfels, Texas. You may visit our website at for agenda postings.
Before each regular session will be an invocation and pledges to the flags. All persons in attendance are invited to participate or not at their own personal discretion.



The following subjects will be discussed, considered, and acted upon:

1. Approve Claims.


1. Retirement Recognition of Kathy L. Klar for twenty-three years of service to the Comal County Clerk's Office and to the citizens of Comal County.

2. Retirement Recognition of Jaime L. Guerrero for over seventeen years of service to the Comal County Road Department and to the citizens of Comal County.

3. Citizens’ Comments. (Citizens’ Comments are limited to three minutes per person. Pursuant to the Texas Open Meetings Act, the Court is limited in its ability to respond to Citizens’ Comments.)

4. Reports by County Staff and Elected Officials on items of Community interest.


2. Discuss and consider approval of the Amendment to Plat, Vintage Oaks at the Vineyard, Unit 4, combining Lots 801 and 802, establishing Lot 801R. (Pct. 1)

3. Discuss and consider acceptance of surety extensions for Irrevocable Standby Letters of Credit No. 25662-S and No. 25730-S for storm water drainage improvements within Comal Texas Star Subdivision, Unit One, or direct the County Engineer to take appropriate action. (Pct. 1)

4. Discuss and consider accepting the extension of Construction Bond No. 0426477, Continuation Certificate, dated May 12, 2015, as surety for site improvements for Copper Ridge, Phase 3B. (Pct. 2)

5. Discuss and consider accepting for maintenance a portion of Flaman Road conditioned on the County Engineer’s approval of the completed improvements identified in the Private Improvement within Public Right of Way Permit #101584. (Pct. 4)

6. Discuss and consider approval of the Amending Plat of Mystic Shores, Unit Ten, amending Lots 1174 and 1175, establishing Lots 1174AP and 1175AP. (Pct. 4)

7. Discuss and consider acceptance of check donation from Heath and Denise Woods in the amounts of $2,496 to be deposited into line item 010-041-5615. (Pct. 4)

8. Discuss and consider approval of Canyon Lake Little League’s proposed installation of safety nets at Hidden Valley Sports Park through volunteer labor. (Pct. 4)

9. Discuss and consider approval of Public Official Bond in the amount of $3000.00 for Kory Klabunde, County Fire Marshal.

10. Discuss and consider approval of expenditures for SWAT Team and Criminal Investigations Division from the Sheriff's Office Federal Asset Forfeiture Account.

11. Discuss and consider approval of proposal from BlueScope Construction for the construction of the Comal County Bulverde Annex to include; Justice of the Peace Precinct 2, Tax Office, County Clerk, and Constable Precinct 2 utilizing State of Texas TXMAS Contract #TXMAS-4-56050 and authorize Purchasing Director to execute all related documents for the project.

12. Present and award Request for Proposal 2015-320 Bank Depository and authorize Purchasing Director to execute all related documents.

13. Discuss and consider approval of a line-item transfer in the Road and Bridge fund - Administrative, FROM: Surveyors' and Engineers' Fees, TO: Building Improvements, for the installation of a 3,000 gallon trash tank as part of the existing OSSF.


In accordance with Chapter 551 of the Texas Government Code, Subchapter D, Commissioners Court may convene in a closed session to discuss any of the following items; any final action or vote taken will be in public.

(A) Deliberate and consider the purchase, exchange, lease or value of real property, in accordance with Section 551.072, of the Texas Government Code.

(B) Deliberate issues regarding economic development negotiations in accordance with Section 551.087, of the Texas Government Code.

(C) Deliberate pending/ contemplated litigation, settlement offer(s), and matters concerning privileged and unprivileged client information deemed confidential by Rule 1.05 of the Texas Disciplinary Rules of Professional Conduct in accordance with Section 551.071, of the Texas Government Code.

NOTE: Commissioners Court reserves the right to retire into executive session concerning any of the items listed on this Agenda whenever it is considered necessary and legally justified under the Open Meetings Act (Chapter 551 of the Texas Government Code).
