NOTICE is hereby given that a REGULAR meeting of COMMISSIONERS COURT will be held on Thursday, September 03, 2015 at 8:30 AM in the Commissioners Courtroom, 100 Main Plaza, New Braunfels, Texas. You may visit our website at for agenda postings.
Before each regular session will be an invocation and pledges to the flags. All persons in attendance are invited to participate or not at their own personal discretion.



The following subjects will be discussed, considered, and acted upon:

1. Approve Claims.

2. Discuss and consider acceptance of the following donation checks to be deposited to the Comal County Sheriff's Office Jr. Deputy Academy Camps Donation Line Item # 010-000-2348:

a. Check #2166 from Luke Fletcher for $50;

b. Check #1141 from Jessica McAnelly for $20;

c. Check #1274 from Tracy Johndrow for $25;

d. Check #2876 from Randall Edward Johnson for $50;

e. Check #3954 from Chris Smith for $50;

f. Check #1172 from Michael Greve for $150;

g. Check #309 from Erik Boatman for $100;

h. Check #2556 from Tim Ullrich for $50;

3. Proclamation naming September 2015 as “Family Mealtime 2015, Making it Fun!” in Comal County.

1. Citizens’ Comments. (Citizens’ Comments are limited to three minutes per person. Pursuant to the Texas Open Meetings Act, the Court is limited in its ability to respond to Citizens’ Comments.)

2. Retirement Recognition of Vicki L. Smith for over nine years of service to the Comal County Tax Assessor-Collector’s Office and to the citizens of Comal County.

3. Reports by County Staff and Elected Officials on items of Community interest.


5. Discuss and consider authorizing Commissioner Eccleston to negotiate with Southstar at Vintage Oaks, LLC for the acquisition of road right-of-way along S. Cranes Mill Road. (Pct. 1)

6. Discuss and consider approval of, and authorize the County Judge to sign, the following Amendments to Plats:

a. Canyon Lake Hills, Unit No. 1, combining Lots 580 and 581, establishing Lot 580R (Pct. 1)

b. Combining Lot 810 of Vintage Oaks at the Vineyard, Unit 4, with Lot 808R of the Amendment to Plat of Vintage Oaks at the Vineyard, Unit 4, establishing Lot 808RR (Pct. 1)

7. Discuss and consider approval of a private street name, Schofield Way, situated off the south side of FM 1863, approximately 75 feet northwest of the intersection of FM 1863 and Roadrunner Way, within Comal County, Texas. (Pct. 2)

8. Discuss and consider approval of, and authorize the County Judge to sign, the following Amendments to Plats:

a. River Chase, Unit Eight, combining Lots 1302 and 1303, establishing Lot 1302R (Pct. 4)

b. The Summit North, Phase 5, combining Lots 264 and 265, establishing Lot 264R (Pct. 4)

c. Cypress Cove, Section Three, combining Lots 519 and 520, establishing Lot 519R (Pct. 4)

d. Combining Lot 86 of Cypress Cove, Section One, and Lot 84R of the Vacate and Resubdivision Plat of Cypress Cove, Section One, establishing Lot 84RR (Pct. 4)

9. Discuss and consider approval of refunds (over $2,500.00) of ad valorem tax overpayments or erroneous payments and authorize the Comal County Tax Assessor-Collector to remit refund payments.

10. Discuss and consider approval of the July 2015 Treasurer's Monthly Report.

11. Discuss and consider approval of Resolution #2015-34 adopting fees to be charged by various Comal County Offices in 2016.

12. Discuss and consider ratifying the property tax increase in accordance with the approved Comal County Budget for 2016.

13. Discuss and consider approval of Order #361 setting the 2015 Tax Rate for Comal County and move that the property tax rate will be increased by the adoption of a tax rate of $0.342921.

14. Discuss and consider approval of a budget amendment in Criminal District Attorney, FROM: General Fund Reserves, TO: CDA Supplement 2, FICA, and Retirement, to cover the state mandated supplement for the remainder of the year.

15. Discuss and consider approval of a line-item transfer in I.T., FROM: Software, TO: Recurring Contracts and Non-Capital Equipment, to cover costs related to the current phone system due to the delayed implementation of the new phone system.

16. Discuss and consider award of BID 2015-440 - Automated Speed Signs, and authorize Purchasing Director to execute all related documents.


In accordance with Chapter 551 of the Texas Government Code, Subchapter D, Commissioners Court may convene in a closed session to discuss any of the following items; any final action or vote taken will be in public.

(A) Deliberate and consider the purchase, exchange, lease or value of real property, in accordance with Section 551.072, of the Texas Government Code.

(B) Deliberate issues regarding economic development negotiations in accordance with Section 551.087, of the Texas Government Code.

(C) Deliberate pending/ contemplated litigation, settlement offer(s), and matters concerning privileged and unprivileged client information deemed confidential by Rule 1.05 of the Texas Disciplinary Rules of Professional Conduct in accordance with Section 551.071, of the Texas Government Code.

NOTE: Commissioners Court reserves the right to retire into executive session concerning any of the items listed on this Agenda whenever it is considered necessary and legally justified under the Open Meetings Act (Chapter 551 of the Texas Government Code).
