COMMISSIONERS COURT OF COMAL COUNTY TEXAS

NOTICE is hereby given that a REGULAR meeting of COMMISSIONERS COURT will be held on Thursday, October 15, 2015 at 8:30 AM in the Commissioners Courtroom, 100 Main Plaza, New Braunfels, Texas. You may visit our website at www.co.comal.tx.us for agenda postings.
Before each regular session will be an invocation and pledges to the flags. All persons in attendance are invited to participate or not at their own personal discretion.

1. Approve Claims.

2. Proclamation recognizing October 23-31, 2015 as "Red Ribbon Week" in Comal County.

WORKSHOP AGENDA:

1. Recognition of Employees for years of service to Comal County.

2. Citizens’ Comments. (Citizens’ Comments are limited to three minutes per person. Pursuant to the Texas Open Meetings Act, the Court is limited in its ability to respond to Citizens’ Comments.)

3. Reports by County Staff and Elected Officials on items of Community interest.

4. Presentation of the Public Health September 2015 Report.

5. Presentation of the Comal County Public Information Office Report.

6. Presentation of the Emergency Management quarterly report.

ACTION AGENDA CONTINUED:

3. Discuss and consider approval of the Amendment to Plat of Vintage Oaks at the Vineyard, Unit 1, combining Lots 55 and 56, establishing Lot 55R. (Pct. 1)

4. Discuss and consider final approval of Vintage Oaks at the Vineyard, Unit 10, grant variance request, accept Construction Bond #1118546 as surety for road construction and storm water drainage improvements, and authorize Commissioner Eccleston to sign said variance request and surety bond. (Pct. 1)

5. Discuss and consider acceptance of the dedication of public road right-of-way within Lake Ridge at Canyon Lake, Unit Three and accept the road into the Comal County Unit Road System, acknowledge the construction of private storm water drainage improvements, and release the associated surety, Construction Bond #0426483, or direct the County Engineer to take appropriate action. (Pct. 4)

6. Discuss and consider approval of Request for Right-of-Entry to Poznecki Camarillo, Inc. for Property ID #73921 and authorize Commissioner Eccleston to sign.

7. Discuss and consider approval of Order #366 to Abate Nuisance at 804 Buckingham Drive.

8. Discuss and consider approval of Tax Assessor-Collector’s Monthly Collection Report – September 2015

9. Discuss and consider approval of Resolutions authorizing sale of certain properties for less than amount of delinquent taxes owed.

10. Discuss and consider approval of the following Agreements between Texas Association of Counties Health and Employee Benefits Pool and Comal County, and authorize Commissioner Eccleston to sign:

a) Administrative Services Agreement; and

b) Stop-Loss Agreement.

11. Discuss and consider approval of Texas Association of Counties Risk Management Pool's Liability Renewal Questionnaire and authorize Commissioner Eccleston to sign.

12. Discuss and consider approval of Interlocal Agreement for Household Hazardous Waste Collection by and between the City of New Braunfels and the County of Comal, and authorize Commissioner Eccleston to sign.

13. Discuss and consider approval of Interlocal Assistance Agreement - Regional Auto Theft Enforcement Task Force, and authorize Commissioner Eccleston to sign.

14. Discuss and consider approval of SAVNS Maintenance Grant Contract No. 1659531 between the Office of the Attorney General and Comal County, and authorize Commissioner Eccleston to sign.

15. Discuss and consider approval of Appriss R-12 Service Agreement Renewal Notice and authorize Commissioner Eccleston to sign.

16. Discuss and consider approval of Resolution 2015-35 Nominating Candidates for the Comal Appraisal District Board of Directors.

17. Discuss and consider appointment of Angie Thompson to the Comal County Child Welfare Board.

18. Present and consider award of Bid 2015-105 - Traffic Control Supplies, Materials, and Equipment, and authorize Director of Purchasing to execute all related documents.

19. Discuss and consider approval of a budget amendment transferring the remaining 2009 McKenna Foundation donation, FROM: General Fund - Unearned Revenues - Census Funds, TO: Veterans Treatment Court Fund - Donations, in accordance with the McKenna Foundation approval.

20. Discuss and consider approval of a budget amendment in Administrative Costs, FROM: General Fund Reserves, TO: Nuisance Abatement/Hazardous Material to cover the cost of building removal and trash clean up.

21. EXECUTIVE SESSIONS:

In accordance with Chapter 551 of the Texas Government Code, Subchapter D, Commissioners Court may convene in a closed session to discuss any of the following items; any final action or vote taken will be in public.

(A) Deliberate and consider the purchase, exchange, lease or value of real property, in accordance with Section 551.072, of the Texas Government Code.

(B) Deliberate issues regarding economic development negotiations in accordance with Section 551.087, of the Texas Government Code.

(C) Deliberate pending/ contemplated litigation, settlement offer(s), and matters concerning privileged and unprivileged client information deemed confidential by Rule 1.05 of the Texas Disciplinary Rules of Professional Conduct in accordance with Section 551.071, of the Texas Government Code.

NOTE: Commissioners Court reserves the right to retire into executive session concerning any of the items listed on this Agenda whenever it is considered necessary and legally justified under the Open Meetings Act (Chapter 551 of the Texas Government Code).
