NOTICE is hereby given that a REGULAR meeting of COMMISSIONERS COURT will be held on Thursday, November 12, 2015 at 8:30 AM in the Commissioners Courtroom, 100 Main Plaza, New Braunfels, Texas. You may visit our website at for agenda postings.
Before each regular session will be an invocation and pledges to the flags. All persons in attendance are invited to participate or not at their own personal discretion.



The following subjects will be discussed, considered, and acted upon:

1. Approve Claims.

2. Proclamation recognizing the Pilot Club of Canyon Lake, Inc. for Forty Years of Service to Comal County.


1. Citizens’ Comments. (Citizens’ Comments are limited to three minutes per person. Pursuant to the Texas Open Meetings Act, the Court is limited in its ability to respond to Citizens’ Comments.)

2. Presentation of the Public Health October 2015 Report.

3. Reports by County Staff and Elected Officials on items of Community interest.


3. Discuss and consider approval of a proposal from the Mountain Springs Ranch Property Owners Association that Comal County accept the public dedication of the private roads, Holland Springs and Mount Bear, within The Estates at Mountain Springs Ranch, and assume maintenance responsibilities of said roads; and direct the County Engineer to take appropriate action. (Pct. 1)

4. Discuss and consider approval of Resolution No. 2015-37, Endorsing Projects to the Texas Department of Transportation for the Alamo Area Metropolitan Planning Organization’s “FY 2017-2020 Transportation Improvement Program Surface Transportation Program – Metro Mobility Funding Call for Projects” for Projects within Comal County.

5. Discuss and consider approval of the Texas Department of State Health Services One Time Discretionary Unique Contract 2016-004037-00 contract and authorize electronic submission on behalf of County Judge

6. Discuss and consider approval of 2016-2017 Veterans Treatment Court Grant Application through the Texas Veterans Commission and authorize County Judge to sign.

7. Discuss and consider approval of Order #368 Establishing an Alternative Dispute Resolution System in Comal County Pursuant to Civil Practice and Remedies Code Chapter 152.

8. Discuss and consider approval of Agreement for Alternative Dispute Resolution Services by and between Comal County, Texas, and Central Texas Alternative Dispute Resolution, Inc., and authorize County Judge to sign.

9. Discuss and consider approval of a line-item transfer in Commissioners Court, FROM: Public Meetings, TO: Office Supplies, to cover the cost of office supplies for the remainder of the year.

10. Discuss and consider approval of a line-item transfer in Constable Precinct #4, From: Various lines To: Non-Capital Equipment for the purchase of equipment for canine unit.

11. Discuss and consider approval of the elimination of one Accounts Payable position (PG9-14) and the creation a new Accounts Payable Supervisor/Budget Position (PG N14-2) in the Auditor's office, no budget amendment required.

12. Discuss and consider approval of a budget amendment in the 2015 General Fund in the amount of $10,000, From: General Fund Reserves, To: Parks Department - Parks Operations for replacement of the fence at Jumbo Evans Park and amend the 2016 budget in the amount of $10,000 From: Parks Department Parks Operations, To: General Fund Reserves.

13. Canvass results of the November 3, 2015 Constitutional Amendment Election.

14. Canvass results of the November 3, 2015 Proposed Incorporation of the City of Spring Branch, Texas Election.

15. Discuss and consider approval of a Resolution No. 2015-38 Canvassing the Returns and Declaring the Results of a Bond Election; and other matters in Connection Therewith.


In accordance with Chapter 551 of the Texas Government Code, Subchapter D, Commissioners Court may convene in a closed session to discuss any of the following items; any final action or vote taken will be in public.

(A) Deliberate and consider the purchase, exchange, lease or value of real property, in accordance with Section 551.072, of the Texas Government Code.

(B) Deliberate issues regarding economic development negotiations in accordance with Section 551.087, of the Texas Government Code.

(C) Deliberate pending/ contemplated litigation, settlement offer(s), and matters concerning privileged and unprivileged client information deemed confidential by Rule 1.05 of the Texas Disciplinary Rules of Professional Conduct in accordance with Section 551.071, of the Texas Government Code.

NOTE: Commissioners Court reserves the right to retire into executive session concerning any of the items listed on this Agenda whenever it is considered necessary and legally justified under the Open Meetings Act (Chapter 551 of the Texas Government Code).
