NOTICE is hereby given that a REGULAR meeting of COMMISSIONERS COURT will be held on Thursday, December 03, 2015 at 8:30 AM in the Commissioners Courtroom, 100 Main Plaza, New Braunfels, Texas. You may visit our website at for agenda postings.
Before each regular session will be an invocation and pledges to the flags. All persons in attendance are invited to participate or not at their own personal discretion.



The following subjects will be discussed, considered, and acted upon:

1. Approve Claims.


1. Citizens’ Comments. (Citizens’ Comments are limited to three minutes per person. Pursuant to the Texas Open Meetings Act, the Court is limited in its ability to respond to Citizens’ Comments.)

2. Reports by County Staff and Elected Officials on items of Community interest.



2. Discuss and consider final approval of Vintage Oaks at the Vineyard, Unit 11, accept Construction Bond #1118778 as surety for road construction and storm water drainage improvements, grant variance requests, and authorize County Judge to sign said variance requests and surety bond. (Pct. 1)

3. Discuss and consider accepting the roads within Johnson Ranch Subdivision – Unit 1, Phase 2, into the Comal County Unit Road System, accepting the dedication of public right-of-way, acknowledging the completion of the private water, wastewater, and drainage improvements, releasing associated sureties, Irrevocable Letters of Credit No. 991 and 992, and direct the County Engineer to issue PIPROW Permit #101943 or take appropriate action. (Pct. 2)

4. Discuss and consider approval of the temporary closure of various County roads in Sattler on Saturday, December 12, 2015, from 11:00 a.m. to 1:00 p.m., for the Annual Canyon Lake Christmas Parade. (Pct. 4)

5. Discuss and consider directing the Rural Recycling Department to accept natural Christmas trees and natural decorative holiday greenery from individual residents at no charge from December 29, 2015 through January 16, 2016.

6. Discuss and consider approval of the Treasurer's Monthly Report for October 2015.

7. Discuss and consider approval of Business Associates Agreement for Web-Based Enrollment System between MGM Benefits Group and Comal County, and authorize County Judge to sign.

8. Discuss and consider approval of Ameriflex Administrative Services Agreement and authorize County Judge to sign.

9. Discuss and consider approval of Comal County Wellness Policy Statement.

10. Discuss and consider approval of Resolution 2015-40 Determining Votes Cast to Elect Directors for the Comal Appraisal District Board of Directors for the Years 2016-2017.

11. Discuss and consider approval of reclassifying one Deputy position (pay group 9) to a Corporal position (pay group 10) in the Sheriff's office. No budget amendment is required.

12. Discuss and consider approval of a budget amendment in Administrative Costs, FROM: General Fund Reserves, TO: Postage, to cover mailing costs for the remainder of the year.

13. Discuss and consider approval of a line-item transfer in the Auditor's office, FROM: Assistant Auditors and Recurring Contracts, TO: Non-Capital Equipment, to cover the cost of 2 new check printers and a check sealing machine to work with the new financial software.

14. Discuss and consider approval of a line-item transfer in District Clerk, FROM: Hospitalization and Books & Publications, TO: Office Supplies, Telephone, Continuing Ed/Travel, and Dues, to cover costs for the remainder of the year.

15. Discuss and consider approval of a line-item transfer in Human Resources, FROM: Clerk I Salaries, TO: Recognition Program, Pre-employment Screening, Telephone, and Computer Components & Software, to cover additional expenses through the end of the year and for the purchase of software.


In accordance with Chapter 551 of the Texas Government Code, Subchapter D, Commissioners Court may convene in a closed session to discuss any of the following items; any final action or vote taken will be in public.

(A) Deliberate and consider the purchase, exchange, lease or value of real property, in accordance with Section 551.072, of the Texas Government Code.

(B) Deliberate issues regarding economic development negotiations in accordance with Section 551.087, of the Texas Government Code.

(C) Deliberate pending/ contemplated litigation, settlement offer(s), and matters concerning privileged and unprivileged client information deemed confidential by Rule 1.05 of the Texas Disciplinary Rules of Professional Conduct in accordance with Section 551.071, of the Texas Government Code.

NOTE: Commissioners Court reserves the right to retire into executive session concerning any of the items listed on this Agenda whenever it is considered necessary and legally justified under the Open Meetings Act (Chapter 551 of the Texas Government Code).
