NOTICE OF MEETING

COMMISSIONERS COURT OF COMAL COUNTY TEXAS

NOTICE is hereby given that a REGULAR meeting of COMMISSIONERS COURT will be held on Thursday, February 25, 2016 at 8:30 AM in the Commissioners Courtroom, 100 Main Plaza, New Braunfels, Texas. You may visit our website at www.co.comal.tx.us for agenda postings.
Before each regular session will be an invocation and pledges to the flags. All persons in attendance are invited to participate or not at their own personal discretion.

The following subjects will be discussed, considered, and acted upon:

1. Approve Claims.

WORKSHOP AGENDA:

1. Citizens’ Comments. (Citizens’ Comments are limited to three minutes per person. Pursuant to the Texas Open Meetings Act, the Court is limited in its ability to respond to Citizens’ Comments.)

2. Presentation by the Boy Scouts of America highlighting Scouting's local impact in 2015.

3. Reports by County Staff and Elected Officials on items of Community interest.

ACTION AGENDA CONTINUED:

2. Public hearing to consider calling an election for the improvements and assessments for the roads within The Estates at Mountain Springs Ranch, pursuant to Chapter 253 of the Texas Transportation Code. (Pct. 1)

3. Discuss and consider calling an election for the improvements and assessments for the roads within The Estates at Mountain Springs Ranch, with conditions, and if appropriate, direct the County Engineer to send ballots to the affected real property owners within the subdivision. (Pct. 1)

4. Discuss and consider approval of the following Amendments to Plats, and authorize the County Judge to sign the Amendments to Plats.

A. Mountain Springs Ranch, Unit One, combining Lots 79 and 80, establishing Lot 79R (Pct. 1);

B. Arrowhead Village, Unit 3, combining Lots 88, 89 and 90, establishing Lot 88R (Pct. 1); and

C. Canyon Springs Resort, Unit No. 4, combining Lots 16 and 17 of Block 53, establishing Lot 16R (Pct. 1).

5. Discuss and consider approval of the following Amendments to Plats, and authorize the County Judge to sign the Amendments to Plats.

A. The Summit, Phase 3, combining Lots 162 and 163, establishing Lot 162R (Pct. 4) and

B. The Legends at Rancho Del Lago, Unit 3, combining Lots 248 and 249, establishing Lot 248R (Pct. 4).

6. Discuss and consider approval of the 2016 Comal County Parks Selection Committee recommendations for parks funding.

7. Discuss and consider approval of the following Interlocal Agreements between Comal County, Texas and the City of Spring Branch, Texas:

A. Interlocal Agreement Regarding the Administration of the City of Spring Branch Flood Damage Prevention Ordinance;

B. Interlocal Agreement for On-Site Sewage Facility Permitting and Enforcement;

C. Interlocal Agreement Relating to Road Repairs and Routine Maintenance within the Public Right-of-Way;

D. Interlocal Agreement for Subdivision Regulation within the Extraterritorial Jurisdiction of the City of Spring Branch in Comal County; and

E. Interlocal Agreement for Law Enforcement Services.

8. Discuss and consider approval of Resolution # 2016-3 approving the submission of Grant #2005809 to the Office of the Governor, Criminal Justice Division, for the funding of the Comal County Challenge Court.

9. Discuss and consider approval of Resolution #2016-4 approving the submission of Grant Application to the Office of the Governor, Criminal Justice Division for the funding of the Comal County Accountability Court.

10. Discuss and consider approval of Resolution #2016-5 approving the submission of Grant Application to the Office of the Governor, Criminal Justice Division for the funding of the project "Improving Victim Services with Designated Domestic Violence Detective".

11. Discuss and consider acceptance of the Statement of Financial Position for the Fiscal Year ending 8/31/2015 from the Community Supervision and Corrections Department pursuant to Local Government Code, Section 140.004.

12. Discuss and consider approval of Tax Assessor-Collector’s Monthly Collection Report – January 2016.

13. Discuss and consider approval of Tax Assessor-Collector’s Yearly Collection Report for January – December 2015.

14. Discuss and consider acceptance of the 2015 Chapter 59 Asset Forfeiture Report for the Sheriff's Office.

15. Discuss and consider approval of the 2015 Equitable Sharing Agreement and Certification for the Sheriff's Office and authorize County Judge to sign.

16. Discuss and consider approval of 2015 Equitable Sharing Agreement and Certification for Constable Precinct #4 and authorize County Judge to sign.

17. Discuss and consider approval of the 2015 Equitable Sharing Agreement and Certification for the Criminal District Attorney's Office and authorize County Judge to sign.

18. Discuss and consider acceptance of a sole source statement from Purchasing Director and consider approval of Order #372 for the Discretionary Exemption of Tyler Technologies for maintenance of Odyssey.

19. EXECUTIVE SESSIONS:

In accordance with Chapter 551 of the Texas Government Code, Subchapter D, Commissioners Court may convene in a closed session to discuss any of the following items; any final action or vote taken will be in public.

(A) Deliberate and consider the purchase, exchange, lease or value of real property, in accordance with Section 551.072, of the Texas Government Code.

(B) Deliberate issues regarding economic development negotiations in accordance with Section 551.087, of the Texas Government Code.

(C) Deliberate pending/ contemplated litigation, settlement offer(s), and matters concerning privileged and unprivileged client information deemed confidential by Rule 1.05 of the Texas Disciplinary Rules of Professional Conduct in accordance with Section 551.071, of the Texas Government Code.

NOTE: Commissioners Court reserves the right to retire into executive session concerning any of the items listed on this Agenda whenever it is considered necessary and legally justified under the Open Meetings Act (Chapter 551 of the Texas Government Code).
