COMMISSIONERS COURT OF COMAL COUNTY TEXAS

NOTICE is hereby given that a REGULAR meeting of COMMISSIONERS COURT will be held on Thursday, March 17, 2016 at 8:30 AM in the Commissioners Courtroom, 100 Main Plaza, New Braunfels, Texas. You may visit our website at www.co.comal.tx.us for agenda postings.

2. Discuss and consider acceptance of check donation from Bulverde Little League in the amount of $21,200 to be deposited into line item 010-041-5615.

4. Discuss and consider approval of the final Amending Plat of the Vacating and Replatting of JDJ Ranch, amending Lots 29 and 30, establishing Lots 29AP and 30AP; and authorize County Judge to sign the amending plat. (Pct. 1)

9. Discuss and consider accepting Irrevocable Standby Letter of Credit, FTFC – 16062, as surety for road and drainage improvements, within Johnson Ranch North – Unit 10. (Pct. 2)

10. Discuss and consider approval of the following Amendments to Plats:

A) Tanglewood Shores Subdivision on Canyon Lake, combining Lots 105 and 106, establishing Lot 105R (Pct. 4);

B) Cypress Cove, Section Three, combining Lots 542 and 543, establishing Lot 542R (Pct. 4); and

C) Cypress Cove, Section 5, combining Lots 69 and 70, establishing Lot 69R (Pct. 4); and authorize County Judge to sign the Amendments to Plats.

11. Discuss and consider approval of Amendment of Solicitation/Modification of Contract W9126G-15-P-0064 with the US Army Corps of Engineers Fort Worth and authorize County Judge to sign.

12. Discuss and consider approval of Tax Assessor-Collector’s Monthly Collection Report – February 2016.

13. Discuss and consider approval of refunds (over $2,500.00) of ad valorem tax overpayments or erroneous payments and authorize the Comal County Tax Assessor-Collector to remit refund payments.

15. Discuss and consider approval and authorize County Judge to sign the following:

A) Agreement by and between Vigilant Solutions, Inc. and Comal County, Texas;

B) ECS Merchant Processing Application & Agreement;

C) Addendum One to ECS Merchant Processing Agreement; and

D) Addendum to Merchant Processing Agreement by and between U.S. Alliance Group, Inc. d/b/a Electronic Cash Systems and Comal County, Texas.

16. Discuss and consider approval of a budget amendment in Commissioners Court, FROM: General Fund Reserves in the amount of $3,200.00, TO: Courthouse Restoration History/Tours, to cover additional costs.

17. Discuss and consider approval of a budget amendment in Emergency Management, FROM: General Fund Reserves in the amount of $115,000.00, TO: Capital Equipment, to cover the County's share of the flood warning system that was budgeted in 2015.

18. Discuss and consider approval of a budget amendment in Environmental Health, FROM: General Fund Reserves in the amount of $22,416.00, TO: Capital Equipment, for the purchase of a new truck.

19. Discuss and consider approval of Order #373 for the disposition of surplus property located at 30450 Cougar Bend, Bulverde.

20. Discuss and consider approval of Supplemental Agreement to Bid 2014-111 Dense Graded Hot Mix Asphalt Type B Coarse Surface with:

A) Century Asphalt:

B) Colorado Materials;and authorize Purchasing Director to execute all related documents.

21. Discuss and consider approval of Supplemental Agreement to Bid 2015-123 Flexible Base, Type A, Grade 2 with:

A) Brauntex Materials;

B) Colorado Materials; and authorize Purchasing Director to execute all related documents.

22. EXECUTIVE SESSIONS:

In accordance with Chapter 551 of the Texas Government Code, Subchapter D, Commissioners Court may convene in a closed session to discuss any of the following items; any final action or vote taken will be in public.

(A) Deliberate and consider the purchase, exchange, lease or value of real property, in accordance with Section 551.072, of the Texas Government Code.

(B) Deliberate issues regarding economic development negotiations in accordance with Section 551.087, of the Texas Government Code.

(C) Deliberate pending/ contemplated litigation, settlement offer(s), and matters concerning privileged and unprivileged client information deemed confidential by Rule 1.05 of the Texas Disciplinary Rules of Professional Conduct in accordance with Section 551.071, of the Texas Government Code.

NOTE: Commissioners Court reserves the right to retire into executive session concerning any of the items listed on this Agenda whenever it is considered necessary and legally justified under the Open Meetings Act (Chapter 551 of the Texas Government Code).
