COMMISSIONERS COURT OF COMAL COUNTY TEXAS

NOTICE is hereby given that a REGULAR meeting of COMMISSIONERS COURT will be held on Thursday, April 14, 2016 at 8:30 AM in the Commissioners Courtroom, 100 Main Plaza, New Braunfels, Texas. You may visit our website at www.co.comal.tx.us for agenda postings.
Before each regular session will be an invocation and pledges to the flags. All persons in attendance are invited to participate or not at their own personal discretion.

CALL TO ORDER:

The following subjects will be discussed, considered, and acted upon:

1. Approve Claims.

2. Proclamation recognizing April 2016 as Sexual Assault Awareness Month in Comal County.

3. Proclamation recognizing the Slumber Falls Camp Historical Marker and Dedication.

4. Discuss and consider acceptance of check donations from Canyon Lake Youth Football in the amounts of $1,000 and $590 to be deposited into line item 010-041-5615.

5. Discuss and consider acceptance of check donations from Bulverde Youth Soccer Association in the amounts of $1,000, $500 and $500 to be deposited into line item 010-041-5615.

6. Discuss and consider acceptance of the following donations for Constable Pct. #3 Canine Program:

A) O'Haver Plumbing in the amount of $2500;

B) Natural Bridge Wildlife Heritage Foundation in the amount of $2500;

C) Aramendia Plumbing in the amount of $2000;

D) Valmark Chevrolet in the amount of $2000;

E) Comal Apartments in the amount of $750;

F) Greentree Apartments in the amount of $750;

G) Patrick Lynch in the amount of $500;

H) Dr. Mike Poston in the amount of $500;

I) Freiheit Country Store in the amount of $500;

J) C&M Fabrications in the amount of $500;

WORKSHOP AGENDA:

1. Citizens’ Comments. (Citizens’ Comments are limited to three minutes per person. Pursuant to the Texas Open Meetings Act, the Court is limited in its ability to respond to Citizens’ Comments.)

2. Reports by County Staff and Elected Officials on items of Community interest.

3. Presentation by Texas Association of Counties on County Reimbursement Program.

ACTION AGENDA CONTINUED:

7. Discuss and consider accepting an extension for Construction Bond No. 0657405, surety for road construction, within Copper Ridge, Phase 4, and authorize County Judge to sign Change Rider. (Pct. 2)

8. Discuss and consider approval of Resolution No. 2016-09 Authorizing and Creating the Crossings Public Improvement District to Finance Improvements within and/or Related to the Crossings Residential Development Project, in Accordance with Subchapter A of Chapter 372, As Amended, Texas Local Government Code; Authorizing and Directing Publication of this Resolution; Making Certain Findings Relative to the Improvements that are to Result from the District; Providing for Matters Relating to the Foregoing; and Providing an Effective Date.

9. Discuss and consider approval of letter concurring with submission of Foreign Trade Zone subzone and manufacturing authority applications by CGT U.S. Limited, and authorize County Judge to sign.

10. Discuss and consider approval of amended application for 2016-2017 Veterans Treatment Court Grant and authorize County Judge to sign.

11. Discuss and consider approval of the recommendations of the Family Protection Review Committee regarding distribution of Family Protection Account Funds, and authorize distribution of said fund.

12. Discuss and consider approval of Pacesetter K9 Purchase, Sale & Service Agreement for Narcotics Detection Canine on behalf of Constable Precinct #3, and authorize County Judge to sign.

13. Discuss and consider approval of Comal County 4-H Project Center Boarder Agreement and Extension Facility Rules.

14. Discuss and consider approval of Addendum K STAR Kids Benefit Program with Community First Health Plans, Inc. and authorize County Judge to sign.

15. Discuss and consider approval of Order #376 Allowing Retail Fireworks Permit Holders to Sell Fireworks During the Texas Independence Day Fireworks Season, the San Jacinto Day Fireworks Season, and the Memorial Day Fireworks Season.

16. Discuss and consider approval of a budget amendment in the Human Resources Department, FROM: General Fund Reserves in the amount of $6,000.00, TO: Pre-Employment Background Checks (010-026-5416) to cover costs for the remainder of the year.

17. Discuss and consider award of Bid 2016-420 Metal Beam Guard Fence - Blanco Road and authorize Director of Purchasing to execute all related documents.

18. EXECUTIVE SESSIONS:

In accordance with Chapter 551 of the Texas Government Code, Subchapter D, Commissioners Court may convene in a closed session to discuss any of the following items; any final action or vote taken will be in public.

(A) Deliberate and consider the purchase, exchange, lease or value of real property, in accordance with Section 551.072, of the Texas Government Code.

(B) Deliberate issues regarding economic development negotiations in accordance with Section 551.087, of the Texas Government Code.

(C) Deliberate pending/ contemplated litigation, settlement offer(s), and matters concerning privileged and unprivileged client information deemed confidential by Rule 1.05 of the Texas Disciplinary Rules of Professional Conduct in accordance with Section 551.071, of the Texas Government Code.

NOTE: Commissioners Court reserves the right to retire into executive session concerning any of the items listed on this Agenda whenever it is considered necessary and legally justified under the Open Meetings Act (Chapter 551 of the Texas Government Code).
