NOTICE OF MEETING

COMMISSIONERS COURT OF COMAL COUNTY TEXAS

NOTICE is hereby given that a REGULAR meeting of COMMISSIONERS COURT will be held on Thursday, July 14, 2016 at 8:30 AM in the Commissioners Courtroom, 100 Main Plaza, New Braunfels, Texas. You may visit our website at www.co.comal.tx.us for agenda postings.
Before each regular session will be an invocation and pledges to the flags. All persons in attendance are invited to participate or not at their own personal discretion.

1. Citizens’ Comments. (Citizens’ Comments are limited to three minutes per person. Pursuant to the Texas Open Meetings Act, the Court is limited in its ability to respond to Citizens’ Comments.)

2. Reports by County Staff and Elected Officials on items of Community interest.

2. Discuss and consider approval of the Amendment to Plat of Canyon Lake Village, Unit 5, combining Lots 32 and 33, establishing Lot 32R; and authorize County Judge to sign. (Pct. 1)

3. Discuss and consider accepting the extension of Construction Bond No. 0657420, for road construction and other site improvements within Copper Ridge, Phase 5, authorize County Judge to sign associated document(s), or direct the County Engineer to take appropriate action. (Pct. 2)

4. Discuss and consider approval of the Amendment to Plat of Cypress Cove, Section One, combining Lots 235 and 236, establishing Lot 235R; and authorize County Judge to sign. (Pct. 4)

5. Discuss and consider approval of the Tax Assessor-Collector’s Monthly Collection Report – June 2016.

6. Discuss and consider approval of refunds (over $2,500.00) of ad valorem tax overpayments or erroneous payments and authorize the Comal County Tax Assessor-Collector to remit refund payments.

7. Discuss and consider approval of the Texas Department of Emergency Management (TDEM) Fiscal Year 2016 Emergency Management Performance Grant (EMPG) application and authorize County Judge to sign.

8. Discuss and consider filling the County Extension Agent, 4-H & Youth Development position according to the recommendation of the Texas A&M AgriLife District Extension Administrator.

9. Discuss and consider approval of the Texas Association of Counties Health and Employee Benefits Pool 2016-2017 Renewal Notice and Benefit Confirmation, ASO and Stop Loss Exhibit effective 10/01/16 and authorize County Judge to sign.

10. Discuss and consider approval of Allstate Major Medical Complement Coverage, Group Voluntary Accident, Group Voluntary Critical Illness, and Group Voluntary Cancer policies effective 10/01/16.

11. Discuss and consider approval of Guardian Voluntary Dental, Voluntary Vision, and Voluntary Life Insurance renewal plans effective 10/01/16.

12. Discuss and consider approval of Ameriflex Administration Agreement and authorize County Judge to sign.

13. Discuss and consider approval of Employee Assistance Program (EAP) for the 2016-2017 plan year and authorize County Judge to sign.

14. Discuss and consider approval of Unum Insurance employee paid supplemental long term disability policy effective 10/01/16.

15. Discuss and consider approval of Legal Shield and Identity Theft Shield renewal effective 10/01/16.

16. Discuss and consider approval of Catapult Health Service Agreement and authorize County Judge to sign.

17. Discuss and consider approval of Communications Equipment Site Agreement with Tower Assets Newco IX LLC and authorize Purchasing Director to execute all related documents.

18. Discuss and consider approval of Supplemental Agreement to Bid 2015-155 Mulching of Green Waste and authorize Purchasing Director to execute all related document.

19. Discuss and consider approval of replacement vehicle for Sheriff's Office to be funded from existing capital equipment funds.

20. Discuss and consider approval of an Order Restricting Outdoor Burning in the unincorporated areas of Comal County.

21. EXECUTIVE SESSIONS:

In accordance with Chapter 551 of the Texas Government Code, Subchapter D, Commissioners Court may convene in a closed session to discuss any of the following items; any final action or vote taken will be in public.

(A) Deliberate and consider the purchase, exchange, lease or value of real property, in accordance with Section 551.072, of the Texas Government Code.

(B) Deliberate issues regarding economic development negotiations in accordance with Section 551.087, of the Texas Government Code.

(C) Deliberate pending/ contemplated litigation, settlement offer(s), and matters concerning privileged and unprivileged client information deemed confidential by Rule 1.05 of the Texas Disciplinary Rules of Professional Conduct in accordance with Section 551.071, of the Texas Government Code.

(D) Deliberate business and financial issues relating to a contract being negotiated if, before conducting the closed meeting:

(1) the Commissioners Court votes unanimously that deliberation in an open meeting would have a detrimental effect on the position of the Commissioners Court negotiations with a third person; and

(2) the attorney advising the Commissioners Court issues a written determination that deliberation in an open meeting would have a detrimental effect on the position of the Commissioners Court in negotiations with a third person.

NOTE: Commissioners Court reserves the right to retire into executive session concerning any of the items listed on this Agenda whenever it is considered necessary and legally justified under the Open Meetings Act (Chapter 551 of the Texas Government Code).
