COMMISSIONERS COURT OF COMAL COUNTY TEXAS

NOTICE is hereby given that a REGULAR meeting of COMMISSIONERS COURT will be held on Thursday, July 28, 2016 at 8:30 AM in the Commissioners Courtroom, 100 Main Plaza, New Braunfels, Texas. You may visit our website at www.co.comal.tx.us for agenda postings.
Before each regular session will be an invocation and pledges to the flags. All persons in attendance are invited to participate or not at their own personal discretion.

The following subjects will be discussed, considered, and acted upon:

1. Approve Claims.

2. Discuss and consider accepting donation to Sheriff's Office Employee Recognition line item 017-5408 in the amount of $100 from Charles Bartley of Spring Branch, Texas.

WORKSHOP AGENDA:

1. Citizens’ Comments. (Citizens’ Comments are limited to three minutes per person. Pursuant to the Texas Open Meetings Act, the Court is limited in its ability to respond to Citizens’ Comments.)

2. Presentation of the Public Health June 2016 Report

ACTION AGENDA CONTINUED:

3. Public hearing for the proposed Vacate and Replat of Lots 27 and 28AP, Cordova Bend at Canyon Lake, Unit One, establishing Lots 27R and 28APR (Pct. 1)

4. Discuss and consider final approval of the Vacate and Replat of Lots 27 and 28AP, Cordova Bend at Canyon Lake, Unit One, establishing Lots 27R and 28APR; and authorize County Judge to sign application form. (Pct. 1)

5. Discuss and consider approval of the Amendment to Plat of Vintage Oaks at the Vineyard, Unit 8, combining Lots 1065 and 1066, establishing Lot 1065R, and authorize County Judge to sign Amendment to Plat form. (Pct. 1)

6. Discuss and consider approval of a street name, Woodbend St, for a private road branching off the south side of Pegg Ranch road, approximately 1000 feet west of the intersection of Pegg Ranch and FM 2673. (Pct. 1)

7. Discuss and consider approval of a street name, "Davenport Way", for a public road connecting Third St. and Fourth St., between FM 2252 and Bracken Drive, in the Town of Bracken subdivision. (Pct. 2)

8. Discuss and consider accepting the dedication of public road right-of-way within Lake Ridge at Canyon Lake, Unit Three, accepting the road into the Comal County Unit Road System, acknowledging the construction of private storm water drainage improvements, and releasing the associated $10,000.00 cash deposit surety. (Pct. 4)

9. Discuss and consider approval of the Amending Plat of Mystic Shores, Unit Seventeen, amending Lots 1218, 1219, and 1220, establishing Lots 1218AP and 1220AP. (Pct. 4)

10. Discuss and consider granting variance to 30’ front building setback requirement for the existing building encroachment on Lot 356, Block 1, Replat of Comal Hills, Unit No. 1. (Pct. 4)

11. Discuss and consider approval of Agreement for Disclosure of Confidential Tax Information relating to Singing Hills Chapter 381 Economic Development Agreement and authorize County Judge to sign Agreements with all Singing Hills Vendors.

12. Discuss and consider approval of Resolution #2016-18 approving submission of the grant application for the Texas Conversion to the National Incident-Based Reporting System to the Office of the Governor.

13. Discuss and consider approval of trading a Leach Body from Unit #5505 for New Pak-Mor R220C-20 Rear Loader, approved in the 2016 Budget, pursuant to Local Government Code 263.152 (a)(2).

14. EXECUTIVE SESSIONS:

In accordance with Chapter 551 of the Texas Government Code, Subchapter D, Commissioners Court may convene in a closed session to discuss any of the following items; any final action or vote taken will be in public.

(A) Deliberate and consider the purchase, exchange, lease or value of real property, in accordance with Section 551.072, of the Texas Government Code.

(B) Deliberate issues regarding economic development negotiations in accordance with Section 551.087, of the Texas Government Code.

(C) Deliberate pending/ contemplated litigation, settlement offer(s), and matters concerning privileged and unprivileged client information deemed confidential by Rule 1.05 of the Texas Disciplinary Rules of Professional Conduct in accordance with Section 551.071, of the Texas Government Code.

(D) Deliberate business and financial issues relating to a contract being negotiated if, before conducting the closed meeting:

(1) the Commissioners Court votes unanimously that deliberation in an open meeting would have a detrimental effect on the position of the Commissioners Court negotiations with a third person; and

(2) the attorney advising the Commissioners Court issues a written determination that deliberation in an open meeting would have a detrimental effect on the position of the Commissioners Court in negotiations with a third person.

NOTE: Commissioners Court reserves the right to retire into executive session concerning any of the items listed on this Agenda whenever it is considered necessary and legally justified under the Open Meetings Act (Chapter 551 of the Texas Government Code).
