COMMISSIONERS COURT OF COMAL COUNTY TEXAS

NOTICE is hereby given that a REGULAR meeting of COMMISSIONERS COURT will be held on Thursday, August 11, 2016 at 8:30 AM in the Commissioners Courtroom, 100 Main Plaza, New Braunfels, Texas. You may visit our website at www.co.comal.tx.us for agenda postings.
Before each regular session will be an invocation and pledges to the flags. All persons in attendance are invited to participate or not at their own personal discretion.

The following subjects will be discussed, considered, and acted upon:

1. Approve Claims.

WORKSHOP AGENDA:

1. Citizens’ Comments. (Citizens’ Comments are limited to three minutes per person. Pursuant to the Texas Open Meetings Act, the Court is limited in its ability to respond to Citizens’ Comments.)

2. Reports by County Staff and Elected Officials on items of Community interest.

ACTION AGENDA CONTINUED:

2. Discuss and consider approval of Resolution 2016-19, a resolution approving a declaration of violation to the Federal Emergency Management Agency (FEMA) with respect to property located at 18315 Bracken Drive. (Pct. 2)

3. Discuss and consider approval of the Amendment to Plat of Kings Point, combining Lots 25 and 26 of Block 1, establishing Lot 25R. (Pct. 4)

4. Discuss and consider approval of Tax Assessor-Collector’s Monthly Collection Report – July 2016.

5. Discuss and consider approval of Program Management Services Agreement with Broaddus & Associates and authorize County Judge to sign.

6. Discuss and consider approval of Comal County Courthouse Complex Attorney Identification Card Conditions and Procedures.

7. Discuss and consider approval of Interlocal Agreement for the Provision of Law Enforcement Services between Comal Independent School District and Comal County, Texas, and authorize County Judge to sign.

8. Discuss and consider approval of Program Funded State and Local Task Force Agreement between the United States Department of Justice, Drug Enforcement Administration and the Comal County Sheriff's Office, and authorize Sheriff Bob Holder to sign.

9. Discuss and consider approval of Regional Auto Theft Enforcement Task Force Interlocal Assistance Agreement and authorize County Judge to sign.

10. Discuss and consider approval of Interlocal Agreement for Enforcement of Comal County Fire Code between Comal County and the City of Spring Branch, and authorize County Judge to sign.

11. Discuss and consider approval of Interlocal Agreement by and between Comal County and Aransas County for short-term sheltering during a mandatory evacuation and authorize County Judge to sign.

12. Discuss and consider approval of Amendment #6 to Contract No. 2013-041477-001 between the Department of State Health Services and Comal County Health Department and authorize County Judge to sign.

13. Discuss and consider approval of a budget amendment in the amount of $3,000 FROM: Law Library Reserves, TO: Law Library-Office Supplies and Law Library-Travel, to cover additional expenditures discussed during the Law Library committee meeting.

14. EXECUTIVE SESSIONS:

In accordance with Chapter 551 of the Texas Government Code, Subchapter D, Commissioners Court may convene in a closed session to discuss any of the following items; any final action or vote taken will be in public.

(A) Deliberate and consider the purchase, exchange, lease or value of real property, in accordance with Section 551.072, of the Texas Government Code.

(B) Deliberate issues regarding economic development negotiations in accordance with Section 551.087, of the Texas Government Code.

(C) Deliberate pending/ contemplated litigation, settlement offer(s), and matters concerning privileged and unprivileged client information deemed confidential by Rule 1.05 of the Texas Disciplinary Rules of Professional Conduct in accordance with Section 551.071, of the Texas Government Code.

(D) Deliberate business and financial issues relating to a contract being negotiated if, before conducting the closed meeting:

(1) the Commissioners Court votes unanimously that deliberation in an open meeting would have a detrimental effect on the position of the Commissioners Court negotiations with a third person; and

(2) the attorney advising the Commissioners Court issues a written determination that deliberation in an open meeting would have a detrimental effect on the position of the Commissioners Court in negotiations with a third person.

NOTE: Commissioners Court reserves the right to retire into executive session concerning any of the items listed on this Agenda whenever it is considered necessary and legally justified under the Open Meetings Act (Chapter 551 of the Texas Government Code).
