COMMISSIONERS COURT OF COMAL COUNTY TEXAS

NOTICE is hereby given that a REGULAR meeting of COMMISSIONERS COURT will be held on Thursday, September 01, 2016 at 8:30 AM in the Commissioners Courtroom, 100 Main Plaza, New Braunfels, Texas. You may visit our website at www.co.comal.tx.us for agenda postings.
Before each regular session will be an invocation and pledges to the flags. All persons in attendance are invited to participate or not at their own personal discretion.

The following subjects will be discussed, considered, and acted upon:

1. Approve Claims.

2. Proclamation naming September 2016 as Hunger Action Month in Comal County.

3. Discuss and consider accepting the following donations for the Comal County Sheriff's Office Jr. Deputy Academy Camps to be deposited to line item # 010-000-2348 from:

A. Comal Cops for Kids in the amount of $1000.00;

B. New Braunfels Wildlife Ranch in the amount of $200.00;

C. Fraternal Order of Eagles in the amount of $250.00;

D. N.B. Comal County Crime Stoppers in the amount of $181.50;

E. Christus Santa Rosa Hospital in the amount of $500.00;

F. M. Elder State Farm in the amount of $200.00;

G. Treva Huffman in the amount of $50.00;

H. Joseph and Kim Cacchiani in the amount of $75.00;

I. Erik and Stacy Boatman in the amount of $100.00;

J. Marydean Motz in the amount of $40.00 and

4. Discuss and consider accepting donation for the Comal County Sheriff's Office Jr. D.A.R.E program from Comal Cops for Kids in the amount of $1000.00 to be deposited to line item # 010-000-2340.

5. Discuss and consider accepting donation for the Comal County Sheriff's Office Jr. Crime Prevention program from Comal Cops for Kids in the amount of $1000.00 to be deposited to line item # 010-000-2341.

6. Discuss and consider accepting cash donation in the amount of $200.00 from an anonymous donor to be placed in Employee Recognition Line Item 017-5408.

7. Discuss and consider accepting donation to Constable Pct. 4 in the amount of $3,193.16 from Shane, Huntor and Kristi Borland with Express Employment Professionals to be deposited into line-item #010-2334.

WORKSHOP AGENDA:

8. Discuss and consider approval of the Amendment to Plat of Rob’s at the Woodlands, combining Lots 3 and 4, establishing Lot 3R. (Pct. 1)

9. Discuss and consider approval of the Amendment to Plat of Canyon Lake Forest, Unit No. 1, combining Lots 607, 608, and 609, establishing Lot 607R. (Pct. 1)

10. Discuss and consider approval of the Amendment to Plat of Cypress Cove, Section One, combining Lots 173 and 174, establishing Lot 173R. (Pct. 4)

11. Discuss and consider approval of the Water Availability Report submitted by Canyon Lake Water Service Company.

12. Discuss and consider approval of Alamo Area Council of Governments Solid Waste Interlocal Agreement and authorize County Judge to sign.

13. Discuss and consider authorizing the purchase of a 2000 gallon oil distributor instead of 2 dump trucks and a water truck as detailed in the Road and Bridge 2016 capital equipment budget.

14. Discuss and consider approval of Statewide Automated Victim Notification System (SAVNS) Maintenance Grant Contract between the Office of the Attorney General and Comal County and authorize County Judge to sign.

15. Discuss and consider approval of Appriss R-13 Service Agreement Renewal Notice for Automated Victim Notification Services and authorize County Judge to sign.

16. Discuss and consider acceptance of FY 2016 Edward Byrne Memorial Justice Assistance Grant Award and Special Conditions, and authorize County Judge to sign.

17. Discuss and consider approval of Agreement by and between Hill Country MHDD Centers and Comal County, Texas, on behalf of the Comal County Sheriff's Office for Telepsychiatry Services, and authorize County Judge to sign.

18. Discuss and consider approval of Texas 1033 Surplus Property Program Law Enforcement Agency Application for Participation and State Plan of Operation between the State of Texas and the Comal County Constable Precinct #3, and authorize County Judge to sign.

19. Discuss and consider approval of ad valorem tax overpayments or erroneous payments (over $2,500.00) and authorize the Comal County Tax Assessor-Collector to remit refund payments.

20. Discuss and consider approval of Resolutions authorizing sale of certain properties for less than amount of delinquent taxes owed.

21. Discuss and consider approval of Resolution #2016-24 adopting fees to be charged by various Comal County Offices in 2017.

22. Discuss and consider approval of a line-item transfer in Road & Bridge, FROM: Herbicide Materials, TO: Computer Components and Software for new MDS software for chemical substances reports.

23. Discuss and consider approval of a line-item transfer in Auditor's Office, FROM: Recurring Contracts and Hospitalization, TO: Overtime to cover budget shortage.

24. Discuss and consider approval of Supplemental Agreement to Bid Contract 2015-150 Food Service Management for the Comal County Jail Facility and authorize Purchasing Director to sign.

25. Discuss and consider approval of Fifth Amendment to Master Services Agreement to Bid 040-2011-370 with Securus Technologies and authorize Purchasing Director to sign.

26. Discuss and consider approval of First Amendment to Bid Contract 2015-155 with Austin Wood Recycling and authorize Purchasing Director to sign.

27. EXECUTIVE SESSIONS:

In accordance with Chapter 551 of the Texas Government Code, Subchapter D, Commissioners Court may convene in a closed session to discuss any of the following items; any final action or vote taken will be in public.

(A) Deliberate and consider the purchase, exchange, lease or value of real property, in accordance with Section 551.072, of the Texas Government Code.

(B) Deliberate issues regarding economic development negotiations in accordance with Section 551.087, of the Texas Government Code.

(C) Deliberate pending/ contemplated litigation, settlement offer(s), and matters concerning privileged and unprivileged client information deemed confidential by Rule 1.05 of the Texas Disciplinary Rules of Professional Conduct in accordance with Section 551.071, of the Texas Government Code.

(D) Deliberate business and financial issues relating to a contract being negotiated if, before conducting the closed meeting:

(1) the Commissioners Court votes unanimously that deliberation in an open meeting would have a detrimental effect on the position of the Commissioners Court negotiations with a third person; and

(2) the attorney advising the Commissioners Court issues a written determination that deliberation in an open meeting would have a detrimental effect on the position of the Commissioners Court in negotiations with a third person.

(E) Deliberate the evaluation relative to the 2016 2% Salary Adjustment, in accordance with Section 551.074 of the Texas Government Code, of the following employees:

(1) Commissioners Court Coordinator; and

(2) Commissioners Court Secretary.

NOTE: Commissioners Court reserves the right to retire into executive session concerning any of the items listed on this Agenda whenever it is considered necessary and legally justified under the Open Meetings Act (Chapter 551 of the Texas Government Code).
