COMMISSIONERS COURT OF COMAL COUNTY TEXAS

NOTICE is hereby given that a REGULAR meeting of COMMISSIONERS COURT will be held on Thursday, September 08, 2016 at 8:30 AM in the Commissioners Courtroom, 100 Main Plaza, New Braunfels, Texas. You may visit our website at www.co.comal.tx.us for agenda postings.
Before each regular session will be an invocation and pledges to the flags. All persons in attendance are invited to participate or not at their own personal discretion.

CALL TO ORDER:

The following subjects will be discussed, considered, and acted upon:

1. Approve Claims.

2. Discuss and consider acceptance of donation of canine bullet and stab protective vest to Constable Precinct #3 from Vested Interest in K9s, Inc.

WORKSHOP AGENDA:

1. Citizens’ Comments. (Citizens’ Comments are limited to three minutes per person. Pursuant to the Texas Open Meetings Act, the Court is limited in its ability to respond to Citizens’ Comments.)

2. Reports by County Staff and Elected Officials on items of Community interest.

ACTION AGENDA CONTINUED:

3. Discuss and consider approval of the Amendment to Plat of Westhaven Subdivision, combining Lots 18 and 19 of Block 1, establishing Lot 18R. (Pct. 1)

4. Discuss and consider approval of the Amendment to Plat of Canyon Lake Village, Unit No. 1, combining Lots 90 and 91, establishing Lot 90R. (Pct. 1)

5. Discuss and consider waiver of penalties and interest accrued on ad valorem taxes and take appropriate action.

6. Discuss and consider approval of Interlocal Agreement for Household Hazardous Waste Collection by and between the City of New Braunfels and the County of Comal, and authorize County Judge to sign.

7. Discuss and consider approval of Texas Medicaid Provider Enrollment Application.

8. Discuss and consider approval of Amendment to Agreement for Law Enforcement Services between Comal County Water Oriented Recreation District and Comal County, Texas, and authorize County Judge to sign.

9. Discuss and consider approval of Resolutions regarding "Texans Feeding Texans" grant funding for the Texas Department of Agriculture Home-Delivered Meal Grant Program, for the period of September 1, 2016 - August 31, 2017, and authorize County Judge to sign:

A. Resolution 2016-22 certifying that the County has made a Grant to the Comal County Senior Citizen's Foundation, an organization that provides home-delivered meals to home-bound persons in the county who are elderly and/or have a disability and certifying that the County has approved the organization's accounting system or fiscal agent; and

B. Resolution 2016-23 certifying that the County has made a Grant to the Community Council of South Texas, Inc., an organization that provides home-delivered meals to home-bound persons in the county who are elderly and/or have a disability and certifying that the County has approved the organization's accounting system or fiscal agent.

10. Discuss and consider approval of a budget amendment to increase General Fund Revenues - Tax Assessor/Collector Fees for a deposit from the Tax Assessor's V.I.T. (Vehicle Inventory Tax) discretionary funds and to increase the Tax Assessor's budget for Non-Capital Equipment for the same amount, for the purchase of chairs and authorizing the purchase of chairs only instead of the fireproof safe as outlined in the 2016 non-capital equipment budget.

11. Discuss and consider approval of Order # 380 for the disposition of surplus property.

12. Discuss and consider selection of architect for RFQ 2016-510 Professional Services - Redesign of the Comal County Elections Office and authorize Purchasing Director to negotiate contract.

13. EXECUTIVE SESSIONS:

In accordance with Chapter 551 of the Texas Government Code, Subchapter D, Commissioners Court may convene in a closed session to discuss any of the following items; any final action or vote taken will be in public.

(A) Deliberate and consider the purchase, exchange, lease or value of real property, in accordance with Section 551.072, of the Texas Government Code.

(B) Deliberate issues regarding economic development negotiations in accordance with Section 551.087, of the Texas Government Code.

(C) Deliberate pending/ contemplated litigation, settlement offer(s), and matters concerning privileged and unprivileged client information deemed confidential by Rule 1.05 of the Texas Disciplinary Rules of Professional Conduct in accordance with Section 551.071, of the Texas Government Code.

(D) Deliberate business and financial issues relating to a contract being negotiated if, before conducting the closed meeting:

(1) the Commissioners Court votes unanimously that deliberation in an open meeting would have a detrimental effect on the position of the Commissioners Court negotiations with a third person; and

(2) the attorney advising the Commissioners Court issues a written determination that deliberation in an open meeting would have a detrimental effect on the position of the Commissioners Court in negotiations with a third person.

NOTE: Commissioners Court reserves the right to retire into executive session concerning any of the items listed on this Agenda whenever it is considered necessary and legally justified under the Open Meetings Act (Chapter 551 of the Texas Government Code).
