COMMISSIONERS COURT OF COMAL COUNTY TEXAS

NOTICE is hereby given that a REGULAR meeting of COMMISSIONERS COURT will be held on Thursday, September 15, 2016 at 8:30 AM in the Commissioners Courtroom, 100 Main Plaza, New Braunfels, Texas. You may visit our website at www.co.comal.tx.us for agenda postings.
Before each regular session will be an invocation and pledges to the flags. All persons in attendance are invited to participate or not at their own personal discretion.

CALL TO ORDER:

The following subjects will be discussed, considered, and acted upon:

1. Approve Claims.

2. Discuss and consider acceptance of donation from Jet Tax Service in the amount of $100.00 for Commissioner Precinct #4 newsletter to be deposited to line item 010-010-5464.

WORKSHOP AGENDA:

1. Citizens’ Comments. (Citizens’ Comments are limited to three minutes per person. Pursuant to the Texas Open Meetings Act, the Court is limited in its ability to respond to Citizens’ Comments.)

2. Presentation of the Public Health August 2016 Report.

3. Reports by County Staff and Elected Officials on items of Community interest.

ACTION AGENDA CONTINUED:

3. Discuss and consider approval of the Amendment to Plat of Hillcrest Estates, combining Lots 32 and 33, establishing Lot 32R. (Pct. 4)

4. Discuss and consider approval of the Amendment to Plat of Scenic Terrace, Section 1, combining Lots 18 and 19 of Block 5, establishing Lot 18R. (Pct. 4)

5. Discuss and consider approval of the Amendment to Plat of Rancho Del Lago, Phase XII, combining Lots 190 and 191, establishing Lot 190R. (Pct. 4)

6. Discuss and consider approval of the Tax Assessor-Collector’s Monthly Collection Report – August 2016.

7. Discuss and consider approval of Hart Voting System Master Agreement and Warranty, Support and License Agreement, and authorize County Judge to sign.

8. Discuss and consider approval of TCDRS Plan Agreement for Plan Year 2017 and authorize County Judge to sign.

9. Discuss and consider approval of Resolution #2016-25 by the Commissioners Court of Comal County, Texas Authorizing and Approving Publication of Notice of Intention to Issue Certificates of Obligation; Complying with the Requirements Contained in Securities and Exchange Commission Rule 15c2-12; and Providing an Effective Date.

10. Discuss and consider approval of a line-item transfer in Public Health, FROM: Medical Supplies, TO: Non-capital Equipment for the purchase of a vaccine transport cooler.

11. Discuss and consider approval of a line-item transfer in Contract Services, FROM: Community Council of So. Central Texas, TO: Comal County Senior Citizens' Foundation to adjust contracts based on the number of Comal County citizens served.

12. EXECUTIVE SESSIONS:

In accordance with Chapter 551 of the Texas Government Code, Subchapter D, Commissioners Court may convene in a closed session to discuss any of the following items; any final action or vote taken will be in public.

(A) Deliberate and consider the purchase, exchange, lease or value of real property, in accordance with Section 551.072, of the Texas Government Code.

(B) Deliberate issues regarding economic development negotiations in accordance with Section 551.087, of the Texas Government Code.

(C) Deliberate pending/ contemplated litigation, settlement offer(s), and matters concerning privileged and unprivileged client information deemed confidential by Rule 1.05 of the Texas Disciplinary Rules of Professional Conduct in accordance with Section 551.071, of the Texas Government Code.

(D) Deliberate business and financial issues relating to a contract being negotiated if, before conducting the closed meeting:

(1) the Commissioners Court votes unanimously that deliberation in an open meeting would have a detrimental effect on the position of the Commissioners Court negotiations with a third person; and

(2) the attorney advising the Commissioners Court issues a written determination that deliberation in an open meeting would have a detrimental effect on the position of the Commissioners Court in negotiations with a third person.

NOTE: Commissioners Court reserves the right to retire into executive session concerning any of the items listed on this Agenda whenever it is considered necessary and legally justified under the Open Meetings Act (Chapter 551 of the Texas Government Code).
