COMMISSIONERS COURT OF COMAL COUNTY TEXAS

NOTICE is hereby given that a REGULAR meeting of COMMISSIONERS COURT will be held on Thursday, September 22, 2016 at 8:30 AM in the Commissioners Courtroom, 100 Main Plaza, New Braunfels, Texas. You may visit our website at www.co.comal.tx.us for agenda postings.
Before each regular session will be an invocation and pledges to the flags. All persons in attendance are invited to participate or not at their own personal discretion.

2. Discuss and consider approval of the Amendment to Plat of Mountain Springs Ranch, Unit Two, combining Lots 238 and 239, establishing Lot 238R. (Pct. 1)

3. Discuss and consider acknowledging the completion of private roads and other private site improvements within Copper Ridge, Phase 5, and release the associated surety, Construction Bond No. 0657420. (Pct. 2)

4. Discuss and consider approval of the Amendment to Plat(s) of Mystic Shores, Unit One and Mystic Shores, Unit Three, combining Lot 46 of Unit One and Lot 311 of Unit Three, establishing Lot 46R of Unit One. (Pct. 4)

5. Discuss and consider approval of the Amendment to Plat of Mystic Shores, Unit Ten, combining Lots 1138 and 1139, establishing Lot 1138R. (Pct. 4)

7. Discuss and consider approval of the name "Nelly's Ln" for a private road located east of the 4300 block of Summit Hurst Drive, approximately 3/4 mile due east of River Road. (Pct. 4)

9. Discuss and consider approval of Texas Department of State Health Services County Indigent Health Care Program Optional Health Care Services Notification and authorize County Judge to sign.

10. Discuss and consider approval of Letter of Agreement between Comal County and Dorothy Overman, M.D. for Health Authority Services and authorize County Judge to sign.

11. Discuss and consider approval of amended Texas Medicaid Provider Enrollment Application, and authorize Gwen Mills to sign.

12. Discuss and consider approval of Scheduling Addendum to Catapult Onsite Services Agreement and authorize County Judge to sign.

13. Discuss and consider approval of Memorandum of Understanding between Comal County Law Library and Comal County Pertaining to Information Technology Services and authorize County Judge to sign.

14. Discuss and consider approval of Memorandum of Understanding between Texas A&M AgriLife Extension Service and Comal County, Texas Pertaining to Information Technology Services, and authorize County Judge to sign.

15. Discuss and consider approval of a line-item transfer in Road & Bridget, FROM: Hourly Personnel, Parts & Repairs Expense, Boat Ramp Expense, and Training & Education, TO: Road Construction and Maintenance to cover costs of road repairs.

16. Discuss and consider approval of a line-item transfer in Building Maintenance, FROM: Pest Control Services, TO: Lighting Expense for the cost of the courthouse Christmas light installation for 2016.

17. EXECUTIVE SESSIONS:

In accordance with Chapter 551 of the Texas Government Code, Subchapter D, Commissioners Court may convene in a closed session to discuss any of the following items; any final action or vote taken will be in public.

(A) Deliberate and consider the purchase, exchange, lease or value of real property, in accordance with Section 551.072, of the Texas Government Code.

(B) Deliberate issues regarding economic development negotiations in accordance with Section 551.087, of the Texas Government Code.

(C) Deliberate pending/ contemplated litigation, settlement offer(s), and matters concerning privileged and unprivileged client information deemed confidential by Rule 1.05 of the Texas Disciplinary Rules of Professional Conduct in accordance with Section 551.071, of the Texas Government Code.

(D) Deliberate business and financial issues relating to a contract being negotiated if, before conducting the closed meeting:

(1) the Commissioners Court votes unanimously that deliberation in an open meeting would have a detrimental effect on the position of the Commissioners Court negotiations with a third person; and

(2) the attorney advising the Commissioners Court issues a written determination that deliberation in an open meeting would have a detrimental effect on the position of the Commissioners Court in negotiations with a third person.

NOTE: Commissioners Court reserves the right to retire into executive session concerning any of the items listed on this Agenda whenever it is considered necessary and legally justified under the Open Meetings Act (Chapter 551 of the Texas Government Code).
