NOTICE OF MEETING

COMMISSIONERS COURT OF COMAL COUNTY TEXAS

NOTICE is hereby given that a REGULAR meeting of COMMISSIONERS COURT will be held on Thursday, October 13, 2016 at 8:30 AM in the Commissioners Courtroom, 100 Main Plaza, New Braunfels, Texas. You may visit our website at www.co.comal.tx.us for agenda postings.
Before each regular session will be an invocation and pledges to the flags. All persons in attendance are invited to participate or not at their own personal discretion.

CALL TO ORDER:

The following subjects will be discussed, considered, and acted upon:

1. Approve Claims.

2. Discuss and consider acceptance of check donation from Canyon Lake Little League in the amount of $334.65 to be deposited into line item 010-041-5615.

3. Proclamation recognizing October 17-21, 2016 as Chamber of Commerce Week in Comal County.

WORKSHOP AGENDA:

1. Citizens’ Comments. (Citizens’ Comments are limited to three minutes per person. Pursuant to the Texas Open Meetings Act, the Court is limited in its ability to respond to Citizens’ Comments.)

2. Presentation of the Public Health September 2016 Report.

3. Presentation by the Guadalupe Blanco River Authority (GBRA) on the Lower Guadalupe River Basin Feasibility Study.

4. Reports by County Staff and Elected Officials on items of Community interest.

4. Discuss and consider approval of the Amendment to Plat of Vintage Oaks at the Vineyard, Unit 6, combining Lots 930 and 931, establishing Lot 930R. (Pct. 1)

6. Discuss and consider acknowledging the completion of private roads and other private site improvements within Copper Ridge, Phase 4, and release the associated surety, Construction Bond No. 0657405. (Pct. 2)

7. Discuss & consider approval of the Amendment to Plat of Mystic Shores, Unit Eight, combining Lots 983 and 984, establishing Lot 983R. (Pct. 4)

11. Discuss and consider approval of the Texas Association of Counties Health and Employee Benefits Pool Administrative Services Agreement and Stop Loss Agreement, and authorize County Judge to sign.

12. Discuss and consider approval of updates to Comal County Employee Handbook.

13. Discuss and consider approval of updated Exempt and Non-Exempt Time Sheets.

14. Discuss and consider approval of Texas State Board of Pharmacy License Renewal Application and authorize County Judge to sign.

15. Discuss and consider approval of the 2017 Comal County Commissioners Court Meetings Schedule and Exceptions.

16. Discuss and consider approval of the 2017 Comal County Holiday Schedule.

17. Discuss and consider approval of a line-item transfer in Purchasing, FROM: Books & Publications, Recurring Contracts, and Printer Maintenance & Supplies, TO: Continuing Ed/Travel, to allow two buyers to attend the Texas Public Purchasing Association conference.

18. Discuss and consider approval of budget amendment in County Records Preservation Fund, FROM: Records Preservation Fund Reserves, TO: Computer Components & Software, for the purchase of Record on Appeal Creator software for the District Clerk and Electronic Signatures software for the County Clerk.

19. Discuss and consider approval of Letter of Understanding with Keefe Commissary Network and authorize County Judge to sign.

20. Discuss and consider approval of the purchase of one document scanner for Justice of the Peace Precinct 2 utilizing the Justice Court Technology Fund.

21. Present bids received for Bid 2016-450 - Modify Existing Sedimentation Filtration Basin, discuss and consider awarding or rejecting and authorize Purchasing Director to execute all related documents.

22. EXECUTIVE SESSIONS:

In accordance with Chapter 551 of the Texas Government Code, Subchapter D, Commissioners Court may convene in a closed session to discuss any of the following items; any final action or vote taken will be in public.

(A) Deliberate and consider the purchase, exchange, lease or value of real property, in accordance with Section 551.072, of the Texas Government Code.

(B) Deliberate issues regarding economic development negotiations in accordance with Section 551.087, of the Texas Government Code.

(C) Deliberate pending/ contemplated litigation, settlement offer(s), and matters concerning privileged and unprivileged client information deemed confidential by Rule 1.05 of the Texas Disciplinary Rules of Professional Conduct in accordance with Section 551.071, of the Texas Government Code.

(D) Deliberate business and financial issues relating to a contract being negotiated if, before conducting the closed meeting:

(1) the Commissioners Court votes unanimously that deliberation in an open meeting would have a detrimental effect on the position of the Commissioners Court negotiations with a third person; and

(2) the attorney advising the Commissioners Court issues a written determination that deliberation in an open meeting would have a detrimental effect on the position of the Commissioners Court in negotiations with a third person.

NOTE: Commissioners Court reserves the right to retire into executive session concerning any of the items listed on this Agenda whenever it is considered necessary and legally justified under the Open Meetings Act (Chapter 551 of the Texas Government Code).
