COMMISSIONERS COURT OF COMAL COUNTY TEXAS

NOTICE is hereby given that a REGULAR meeting of COMMISSIONERS COURT will be held on Thursday, October 20, 2016 at 8:30 AM in the Commissioners Courtroom, 100 Main Plaza, New Braunfels, Texas. You may visit our website at www.co.comal.tx.us for agenda postings.
Before each regular session will be an invocation and pledges to the flags. All persons in attendance are invited to participate or not at their own personal discretion.

DISCUSS AND CONSIDER BIDS RELATING TO THE SALE OF OBLIGATIONS DESIGNATED AS “COMAL COUNTY, TEXAS COMBINATION TAX AND REVENUE CERTIFICATES OF OBLIGATION, SERIES 2016”; CONSIDERATION AND APPROVAL OF FINANCIAL ADVISOR’S RECOMMENDATION CONCERNING THIS MATTER; AND OTHER MATTERS IN CONNECTION THEREWITH.

10. DISCUSS AND CONSIDER APPROVAL OF ORDER #383 AUTHORIZING THE ISSUANCE OF “COMAL COUNTY, TEXAS COMBINATION TAX AND REVENUE CERTIFICATES OF OBLIGATION, SERIES 2016”; PROVIDING FOR THE PAYMENT OF SAID CERTIFICATES BY THE LEVY OF AN AD VALOREM TAX UPON ALL TAXABLE PROPERTY WITHIN THE COUNTY AND FURTHER SECURING SAID CERTIFICATES BY A LIEN ON AND PLEDGE OF THE PLEDGED REVENUES OF THE SOLID WASTE MANAGEMENT SYSTEM; PROVIDING THE TERMS AND CONDITIONS OF SAID CERTIFICATES AND RESOLVING OTHER MATTERS INCIDENT AND RELATING TO THE ISSUANCE, PAYMENT, SECURITY, SALE, AND DELIVERY OF SAID CERTIFICATES, INCLUDING THE APPROVAL AND DISTRIBUTION OF AN OFFICIAL STATEMENT; AUTHORIZING THE EXECUTION OF A PAYING AGENT/REGISTRAR AGREEMENT AND AN OFFICIAL BID FORM; COMPLYING WITH THE REQUIREMENTS IMPOSED BY THE LETTER OF REPRESENTATIONS ON FILE WITH THE DEPOSITORY TRUST COMPANY; AUTHORIZING THE EXECUTION OF ANY NECESSARY ENGAGEMENT AGREEMENTS WITH THE COUNTY’S FINANCIAL ADVISORS AND/OR BOND COUNSEL; AND PROVIDING AN EFFECTIVE DATE.

11. Discuss and consider approval of Resolution 2016-28 requesting that Farm-to-Market 306 in Comal County from IH-35 to River Chase Boulevard be designated as the Jan Kennady Memorial Highway.

12. Discuss and consider approval of Texas Veterans Commission 2017-2018 Veterans Treatment Court Grant Application and authorize County Judge to sign.

13. Discuss and consider approval of FLSA compliance changes to current employee position classifications for the remainder of 2016 with an effective date of 11/19/2016.

14. Discuss and consider approval of an additional Accounts Payable Clerk Position (N9-2) in the Auditor's Office beginning November 7, 2016. (Position approved in 2017 Budget. No budget amendment required.)

15. Discuss and consider approval of a line-item transfer in Sheriff's Office, FROM: Sheriff's Office Hospitalization, Jail Hospitalization and Sheriff's Office Fuel, TO: Sheriff's Office Capital Equipment to cover the replacement costs of the Sheriff's Office Radio Console System.

16. Discuss and consider approval of budget amendment in Law Library, FROM: Law Library Reserves, TO: Books & Publications, to increase funds for the increased cost of the law library publications.

17. Discuss and consider approval of a line-item transfer in Justice of The Peace #2, FROM: Reimbursed Mileage, Dues, and Interpreter, TO: Continuing Ed/Travel to cover the costs of a TER conference.

18. Discuss and consider approval of the purchase of printer and supplies for Justice of the Peace Precinct 4 utilizing the Justice Court Technology Fund.

19. EXECUTIVE SESSIONS:

In accordance with Chapter 551 of the Texas Government Code, Subchapter D, Commissioners Court may convene in a closed session to discuss any of the following items; any final action or vote taken will be in public.

(A) Deliberate and consider the purchase, exchange, lease or value of real property, in accordance with Section 551.072, of the Texas Government Code.

(B) Deliberate issues regarding economic development negotiations in accordance with Section 551.087, of the Texas Government Code.

(C) Deliberate pending/ contemplated litigation, settlement offer(s), and matters concerning privileged and unprivileged client information deemed confidential by Rule 1.05 of the Texas Disciplinary Rules of Professional Conduct in accordance with Section 551.071, of the Texas Government Code.

(D) Deliberate business and financial issues relating to a contract being negotiated if, before conducting the closed meeting:

(1) the Commissioners Court votes unanimously that deliberation in an open meeting would have a detrimental effect on the position of the Commissioners Court negotiations with a third person; and

(2) the attorney advising the Commissioners Court issues a written determination that deliberation in an open meeting would have a detrimental effect on the position of the Commissioners Court in negotiations with a third person.

NOTE: Commissioners Court reserves the right to retire into executive session concerning any of the items listed on this Agenda whenever it is considered necessary and legally justified under the Open Meetings Act (Chapter 551 of the Texas Government Code).
