NOTICE OF MEETING

COMMISSIONERS COURT OF COMAL COUNTY TEXAS

NOTICE is hereby given that a REGULAR meeting of COMMISSIONERS COURT will be held on Thursday, October 27, 2016 at 8:30 AM in the Commissioners Courtroom, 100 Main Plaza, New Braunfels, Texas. You may visit our website at www.co.comal.tx.us for agenda postings.
Before each regular session will be an invocation and pledges to the flags. All persons in attendance are invited to participate or not at their own personal discretion.

The following subjects will be discussed, considered, and acted upon:

1. Approve Claims.

WORKSHOP AGENDA:

1. Citizens’ Comments. (Citizens’ Comments are limited to three minutes per person. Pursuant to the Texas Open Meetings Act, the Court is limited in its ability to respond to Citizens’ Comments.)

2. Grand prize drawing for the Catapult participant raffle.

3. Presentation of the Sonic Boom 100 Day Challenge winners.

4. Reports by County Staff and Elected Officials on items of Community interest.

ACTION AGENDA CONTINUED:

2. Discuss and consider final approval of Vintage Oaks at the Vineyard, Unit 13, accept a 0.16-acre dedication of right-of-way to the public along State Highway 46 West, approve variance, accept Construction Bond #1118957 as surety for road construction and storm water drainage improvements, and authorize County Judge to sign said variance and surety bond. (Pct. 1)

3. Discuss and consider approval of the Amendment to Plat of Mystic Shores, Unit Eighteen, combining Lots 2081 and 2082, establishing Lot 2081R. (Pct. 4)

4. Discuss and consider approval of the 2017 Comal County Rural Recycling Center Holiday Schedule.

5. Discuss and consider approval of Fiscal Year 2017 Certified Local Government Subgrant between Comal County and the Texas Historical Commission, and authorize County Judge to sign.

6. Discuss and consider approval of Release Agreement by and between Comal County, Texas, and Bradley Lee, and authorize County Judge to sign.

7. Discuss and consider approval of Resolution 2016-29 appointing Commissioner Webb to represent Comal County on the City of New Braunfels Economic Development Strategic Plan Committee.

8. Discuss and consider approval of Interlocal Agreement by and between Comal County, Texas, and Spring Branch, Texas, for Tax Assessing and Collecting Services, and authorize County Judge to sign.

9. Discuss and consider approval of the following Treasurer's Monthly Reports:

(A) April 2016;

(B) May 2016;

(C) June 2016;

(D) July 2016; and

(E) August 2016.

10. Discuss and consider Proposal for Review of Existing Conditions and Feasibility Study by HDR, Inc. and authorize County Judge to sign.

11. Discuss and consider purchase of MCC7500 Dispatch Console for the Comal County Sheriff's Office utilizing the Houston Galveston Area Council Cooperative and authorize Purchasing Director to execute all related documents.

12. Discuss and consider approval of a line-item transfer; FROM: Public Information Office Advertising, Notices and Printing, TO: Employee Recognition Program to cover the remainder of 2016.

13. Discuss and consider approval of a line-item transfer in Jail, FROM: Building Improvements and Medical Services, TO: Extradition Costs and Physicians Contract/Services to cover costs for the remainder of 2016.

14. EXECUTIVE SESSIONS:

In accordance with Chapter 551 of the Texas Government Code, Subchapter D, Commissioners Court may convene in a closed session to discuss any of the following items; any final action or vote taken will be in public.

(A) Deliberate and consider the purchase, exchange, lease or value of real property, in accordance with Section 551.072, of the Texas Government Code.

(B) Deliberate issues regarding economic development negotiations in accordance with Section 551.087, of the Texas Government Code.

(C) Deliberate pending/ contemplated litigation, settlement offer(s), and matters concerning privileged and unprivileged client information deemed confidential by Rule 1.05 of the Texas Disciplinary Rules of Professional Conduct in accordance with Section 551.071, of the Texas Government Code.

(D) Deliberate business and financial issues relating to a contract being negotiated if, before conducting the closed meeting:

(1) the Commissioners Court votes unanimously that deliberation in an open meeting would have a detrimental effect on the position of the Commissioners Court negotiations with a third person; and

(2) the attorney advising the Commissioners Court issues a written determination that deliberation in an open meeting would have a detrimental effect on the position of the Commissioners Court in negotiations with a third person.

NOTE: Commissioners Court reserves the right to retire into executive session concerning any of the items listed on this Agenda whenever it is considered necessary and legally justified under the Open Meetings Act (Chapter 551 of the Texas Government Code).
