COMMISSIONERS COURT OF COMAL COUNTY TEXAS

NOTICE is hereby given that a REGULAR meeting of COMMISSIONERS COURT will be held on Thursday, November 03, 2016 at 8:30 AM in the Commissioners Courtroom, 100 Main Plaza, New Braunfels, Texas. You may visit our website at www.co.comal.tx.us for agenda postings.
Before each regular session will be an invocation and pledges to the flags. All persons in attendance are invited to participate or not at their own personal discretion.

The following subjects will be discussed, considered, and acted upon:

1. Approve Claims.

2. Proclamation recognizing The Comal Independent School District in celebration of 60 Years of Educational Excellence.

WORKSHOP AGENDA:

1. Citizens’ Comments. (Citizens’ Comments are limited to three minutes per person. Pursuant to the Texas Open Meetings Act, the Court is limited in its ability to respond to Citizens’ Comments.)

3. Discuss and consider approval of the Amendment to Plat of Vintage Oaks at the Vineyard, Unit 11, combining Lots 1410 and 1411, establishing Lot 1410R. (Pct. 1)

4. Discuss and consider approval of the Amendment to Plat(s) combining Lots 7, 8, and 9 of Block 49 of Canyon Springs Resort, Unit No. 4, with Lot 10R of Block 49 of an Amendment to Plat of Canyon Springs Resort, Unit No. 4, establishing Lot 7R. (Pct. 1)

5. Discuss and consider approval of the Amendment to Plat of Cypress Cove, Section One, combining Lots 219 and 220, establishing Lot 219R. (Pct. 4)

6. Discuss and consider approval of Electric Line Right-of-Way Agreement with the City of San Antonio and authorize County Judge to sign.

7. Discuss and consider approval of Treasurer's Monthly Report for September 2016.

8. Discuss and consider approval of Resolutions authorizing the sale of certain properties for less than amount of delinquent taxes owed.

9. Discuss and consider approval of the Comal County Auditor's FY 2016 Audit Report for the Criminal District Attorney's Chapter 59 Asset Forfeitures, authorize County Auditor to sign and submit said Audit Report to the Texas Attorney General pursuant to Chapter 59 of the Texas Code of Criminal Procedure.

10. Discuss and consider approval of Addendum to Interlocal Agreement for the Provision of Law Enforcement Services between Comal Independent School District and Comal, County, Texas and authorize County Judge to sign.

11. Discuss and consider approval of new grant funded Domestic Violence Investigator position (LE10) in Sheriff's Office. No budget amendment necessary.

12. Discuss and consider approval of a line-item transfer in Commissioners Court, FROM: Commissioners Court-Travel Pct. #3, TO: Commissioners Court-Travel Pct. #4 to cover overages in travel expenditures.

13. Discuss and consider approval of a line-item transfer in Treasurer, FROM: Books & Publications, Reimbursed Mileage and Office Supplies, TO: Telephone Costs and Continuing Ed/Travel to cover overages and additional costs for the remainder of year.

14. Discuss and consider approval of budget amendment in the amount of $492,759.00, FROM: Road and Bridge Fund Reserves, TO: Land Acquisition US 281 ROW for additional expenditures for ROW CSJ 0253-03-065 project.

15. Discuss and consider approval of a line-item transfer in Indigent Health Care/Comal Care, FROM: Office Supplies, TO: Telephone to provide funds to cover telephone costs for 2016.

16. Discuss and consider approval of a line-item transfer in Public Health, FROM: Medical Supplies, TO: Non-Capital Equipment for the purchase of a vaccine transport cooler.

17. Discuss and consider approval of a line-item transfer in Justice of the Peace #4, FROM: Books and Publications, TO: Copier Lease & Maintenance and Reimbursed Mileage to cover overages and additional costs for the remainder of 2016.

18. Discuss and consider authorizing Purchasing Director to issue Request for Qualifications/Request for Proposal 2016-375 Construction Manager-at-Risk for Comal County Jail Construction and Comal County Sheriff's Office Building Renovation.

19. EXECUTIVE SESSIONS:

In accordance with Chapter 551 of the Texas Government Code, Subchapter D, Commissioners Court may convene in a closed session to discuss any of the following items; any final action or vote taken will be in public.

(A) Deliberate and consider the purchase, exchange, lease or value of real property, in accordance with Section 551.072, of the Texas Government Code.

(B) Deliberate issues regarding economic development negotiations in accordance with Section 551.087, of the Texas Government Code.

(C) Deliberate pending/ contemplated litigation, settlement offer(s), and matters concerning privileged and unprivileged client information deemed confidential by Rule 1.05 of the Texas Disciplinary Rules of Professional Conduct in accordance with Section 551.071, of the Texas Government Code.

(D) Deliberate business and financial issues relating to a contract being negotiated if, before conducting the closed meeting:

(1) the Commissioners Court votes unanimously that deliberation in an open meeting would have a detrimental effect on the position of the Commissioners Court negotiations with a third person; and

(2) the attorney advising the Commissioners Court issues a written determination that deliberation in an open meeting would have a detrimental effect on the position of the Commissioners Court in negotiations with a third person.

NOTE: Commissioners Court reserves the right to retire into executive session concerning any of the items listed on this Agenda whenever it is considered necessary and legally justified under the Open Meetings Act (Chapter 551 of the Texas Government Code).
