COMMISSIONERS COURT OF COMAL COUNTY TEXAS

NOTICE is hereby given that a REGULAR meeting of COMMISSIONERS COURT will be held on Thursday, November 10, 2016 at 8:30 AM in the Commissioners Courtroom, 100 Main Plaza, New Braunfels, Texas. You may visit our website at www.co.comal.tx.us for agenda postings.
Before each regular session will be an invocation and pledges to the flags. All persons in attendance are invited to participate or not at their own personal discretion.

The following subjects will be discussed, considered, and acted upon:

1. Approve Claims.

WORKSHOP AGENDA:

1. Citizens’ Comments. (Citizens’ Comments are limited to three minutes per person. Pursuant to the Texas Open Meetings Act, the Court is limited in its ability to respond to Citizens’ Comments.)

2. Presentation by the Comal County AgriLife Extension Office naming the winner of the best team name for the "Walk Around Comal County".

3. Presentation of the Texas Association of Counties Best Practice Award.

4. Reports by County Staff and Elected Officials on items of Community interest.

ACTION AGENDA CONTINUED:

2. Discuss and consider approval of the Amendment to Plat of Mountain Springs Ranch, Unit Three, combining Lots 425 and 426, establishing Lot 425R. (Pct. 1)

3. Discuss and consider approval of Chapter 381 Economic Development Agreement between Comal County, Texas, and Advance Stores Company, Incorporated, and authorize County Judge to sign.

4. Discuss and consider approval of Agreement for Alternative Dispute Resolution Services by and between Comal County, Texas, and Central Texas Alternative Dispute Resolution Center, Inc., and authorize County Judge to sign.

5. Discuss and consider approval of proposal from Kofile Technologies for Comal County Clerk's Land Records Digitization Project utilizing the State of Texas TXMAS-13-36010 Contract.

6. Discuss and consider approval of Tax Assessor-Collector’s Monthly Collection Report – October 2016.

7. Discuss and consider approval of Tax Levy – Tax year 2016 for the following jurisdictions:

(A) Comal County; and

(B) Lateral Road and Flood Control.

8. Discuss and consider approval of Order #384 authorizing the trade of surplus equipment.

9. Discuss and consider approval of new grant funded Domestic Violence Investigator position (LE10) in Sheriff's Office and corresponding line item transfer, FROM: Sheriff Hourly Personnel, TO: One Time Grants-Domestic Violence Grant-Cash Match.

10. Discuss and consider approval of a line-item transfer FROM: Sheriff Hourly Personnel, TO: Vehicle Maintenance Towing of Vehicles to cover overages and additional towing expenditures for the remainder of 2016.

11. Discuss and consider approval of a line-item transfer in Sheriff's Office, FROM: Hourly Personnel, TO: Graphics to cover costs for the remainder of the year.

12. Discuss and consider approval of a line-item transfer in Auditor's Office, FROM: Elected Officials/Department Head and Hospitalization, TO: Hourly Personnel, Non-Capital Equipment and Telephone to cover overages, additional costs for the remainder of 2016 and the purchase of scanners and printers.

13. Discuss and consider approval of line-item transfers in County Court at Law #2, FROM: Public Defenders/Attorney Fees and Recurring Contracts, TO: Telephone/Aircard Costs, Continuing Education, Mental Commitments and Visiting Judges to cover overages and additional expenditures for the remainder of 2016.

14. Discuss and consider approval of a line-item transfer in Public Health, FROM: Medical Supplies, TO: Medical Waste Disposal to cover additional Stericycle costs for 2016.

15. Discuss and consider approval of line-item transfers in Extension Services, FROM: Travel, FCS Agent and Building/Facilities Maintenance, TO: Demonstration Supplies and Non-capital Equipment to cover overages and the purchase of a digital livestock scale.

16. Discuss and consider approval of the following pertaining to the Comal Trinity Groundwater Conservation Board:

(A) Accept resignation of H.L Saur; and

(B) Appoint Jensie Madden to seat vacated by H.L. Saur.

17. EXECUTIVE SESSIONS:

In accordance with Chapter 551 of the Texas Government Code, Subchapter D, Commissioners Court may convene in a closed session to discuss any of the following items; any final action or vote taken will be in public.

(A) Deliberate and consider the purchase, exchange, lease or value of real property, in accordance with Section 551.072, of the Texas Government Code.

(B) Deliberate issues regarding economic development negotiations in accordance with Section 551.087, of the Texas Government Code.

(C) Deliberate pending/ contemplated litigation, settlement offer(s), and matters concerning privileged and unprivileged client information deemed confidential by Rule 1.05 of the Texas Disciplinary Rules of Professional Conduct in accordance with Section 551.071, of the Texas Government Code.

(D) Deliberate business and financial issues relating to a contract being negotiated if, before conducting the closed meeting:

(1) the Commissioners Court votes unanimously that deliberation in an open meeting would have a detrimental effect on the position of the Commissioners Court negotiations with a third person; and

(2) the attorney advising the Commissioners Court issues a written determination that deliberation in an open meeting would have a detrimental effect on the position of the Commissioners Court in negotiations with a third person.

NOTE: Commissioners Court reserves the right to retire into executive session concerning any of the items listed on this Agenda whenever it is considered necessary and legally justified under the Open Meetings Act (Chapter 551 of the Texas Government Code).
