NOTICE is hereby given that a REGULAR meeting of COMMISSIONERS COURT will be held on Thursday, November 17, 2016 at 8:30 AM in the Commissioners Courtroom, 100 Main Plaza, New Braunfels, Texas. You may visit our website at for agenda postings.
Before each regular session will be an invocation and pledges to the flags. All persons in attendance are invited to participate or not at their own personal discretion.



The following subjects will be discussed, considered, and acted upon:

1. Approve Claims.

2. Discuss and consider accepting the following donations for the use of incentives for participants in the Student and Family Empowerment (SAFE) Program (i.e., Truancy Prevention Program):

(A) 86 Chick-fil-A Promotional Cards;

(B) 89 Dairy Queen Mini-Blizzard Promotional Cards; and

(C) 12 J&R Gymnastics Friday Night Fun Passes.

3. Discuss and consider accepting check donation in the amount of $50.00, from the Canyon Lake United Methodist Church, to be used for food in support the Canyon Lake Evening Reporting Center.


1. Citizens’ Comments. (Citizens’ Comments are limited to three minutes per person. Pursuant to the Texas Open Meetings Act, the Court is limited in its ability to respond to Citizens’ Comments.)

2. Retirement Recognition of Betty R. Lien for over twenty-two years of service to the Comal County Road & Bridge Administration and to the citizens of Comal County.

3. Presentation of Certificate of Achievement for Excellence in Financial Reporting to Jessie Rahe, Interim County Auditor.

4. Presentation of the Public Health October 2016 Report.

5. Reports by County Staff and Elected Officials on items of Community interest.


4. Discuss and consider accepting dedication of right-of-way to the public within Vintage Oaks at the Vineyard, Unit 12, accepting the roads into the Comal County Unit Road System, and releasing the associated surety, Construction Bond #SUR60000745. (Pct. 1)

5. Discuss and consider accepting the dedication of public right-of-way, and accepting the roads within Southstar at Spencer Land Right-of Way Plat, into the Comal County Unit Road System, or direct County Engineer to take appropriate action. (Pct. 3)

6. Discuss and consider approval of Interlocal Cooperation Agreement by and between Comal County and Burnet County for inmate housing and authorize County Judge to sign.

7. Discuss and consider approval of a line-item transfer in Jail, FROM: Building Improvements, TO: Emergency Medical to cover remaining services pertaining to emergency medical expenses.

8. Discuss and consider approval of line-item transfers in Criminal District Attorney, FROM: Hospitalization, TO: Office Supplies, Copier Lease & Maintenance, Telephone/Aircard, Continuing Ed/Travel and Dues to cover overages and expenditures for the remainder of the year.

9. Discuss and consider approval of a line-item transfer in Law Library, FROM: Copier Lease/Maintenance and Cont. Ed./Travel, TO: Books/Publications and Telephone/AirCard to cover additional items for the remainder of 2016.

10. Discuss and consider approval of line-item transfer in Recycling FROM: Equipment Maintenance & Repairs, TO: Equipment & Supplies to cover costs for the rest of the year.


In accordance with Chapter 551 of the Texas Government Code, Subchapter D, Commissioners Court may convene in a closed session to discuss any of the following items; any final action or vote taken will be in public.

(A) Deliberate and consider the purchase, exchange, lease or value of real property, in accordance with Section 551.072, of the Texas Government Code.

(B) Deliberate issues regarding economic development negotiations in accordance with Section 551.087, of the Texas Government Code.

(C) Deliberate pending/ contemplated litigation, settlement offer(s), and matters concerning privileged and unprivileged client information deemed confidential by Rule 1.05 of the Texas Disciplinary Rules of Professional Conduct in accordance with Section 551.071, of the Texas Government Code.

(D) Deliberate business and financial issues relating to a contract being negotiated if, before conducting the closed meeting:

(1) the Commissioners Court votes unanimously that deliberation in an open meeting would have a detrimental effect on the position of the Commissioners Court negotiations with a third person; and

(2) the attorney advising the Commissioners Court issues a written determination that deliberation in an open meeting would have a detrimental effect on the position of the Commissioners Court in negotiations with a third person.

NOTE: Commissioners Court reserves the right to retire into executive session concerning any of the items listed on this Agenda whenever it is considered necessary and legally justified under the Open Meetings Act (Chapter 551 of the Texas Government Code).
