COMMISSIONERS COURT OF COMAL COUNTY TEXAS

NOTICE is hereby given that a REGULAR meeting of COMMISSIONERS COURT will be held on Thursday, March 02, 2017 at 8:30 AM in the Commissioners Courtroom, 100 Main Plaza, New Braunfels, Texas. You may visit our website at www.co.comal.tx.us for agenda postings.
Before each regular session will be an invocation and pledges to the flags. All persons in attendance are invited to participate or not at their own personal discretion.

1. Citizens’ Comments. (Citizens’ Comments are limited to three minutes per person. Pursuant to the Texas Open Meetings Act, the Court is limited in its ability to respond to Citizens’ Comments.)

2. Reports by County Staff and Elected Officials on items of Community interest.

2. Discuss and consider accepting drainage easement for installation of a culvert at 336 Rosewood Dr., Spring Branch, Texas. (Pct. 4)

3. Discuss and consider approval of Texas Commission on Environmental Quality Edward Aquifer Application for the Aboveground Storage Tank (AST) Modification at the Comal County Engineer’s Office, authorize Robert Boyd to represent and act on behalf of Comal County for the purpose of preparing and submitting said Application and authorize County Judge to sign.

4. Discuss and consider approval of Tax Assessor-Collector’s Yearly Collection Report for January – December 2016.

5. Discuss and consider approval of Catapult Onsite Services Agreement Amendment and Scheduling Addendum and authorize County Judge to sign.

6. Discuss and consider approval of the Criminal District Attorney's 2016 Equitable Sharing Agreement and Certification and authorize the County Judge to sign.

7. Discuss and consider acceptance of the Sheriff's Office 2016 Chapter 59 Asset Forfeiture Report.

8. Discuss and consider approval of the Sheriff's 2016 Equitable Sharing Agreement and Certification and authorize the County Judge to sign.

9. Discuss and consider acceptance of the Constable, Precinct #4's 2016 Chapter 59 Asset Forfeiture Report.

10. Discuss and consider approval of the Constable, Precinct #4's 2016 Equitable Sharing Agreement and Certification and authorize the County Judge to sign.

11. Discuss and consider approval of selection of Construction Manager-at-Risk for 2016-375 Comal County Jail Construction and Comal County Sheriff's Office Building Renovation and authorize the Evaluation Committee to negotiate the contract.

12. Discuss and consider approval of Memorandum of Understanding with Creek View Veterinary Clinic for veterinary services and authorize County Judge to sign.

13. Discuss and consider approval for procurement of network security solution utilizing BuyBoard Contract #498-15 and authorize Purchasing Director to execute all related documents.

14. Discuss and consider approval of expenditure out of the Fire Code Enforcement Fund for the purchase of new vehicle for Fire Marshal's Office utilizing the County's Vehicle Bid 2016-100.

15. Discuss and consider approval of a temporary part-time Assistant Auditor position from March 6, 2017 through June 30, 2017. No budget amendment required for 2017.

16. Discuss and consider approval of reclassification of First Assistant Auditor position from pay group E12 to pay group E9, effective February 25, 2017. No budget amendment necessary.

17. EXECUTIVE SESSIONS:

In accordance with Chapter 551 of the Texas Government Code, Subchapter D, Commissioners Court may convene in a closed session to discuss any of the following items; any final action or vote taken will be in public.

(A) Deliberate and consider the purchase, exchange, lease or value of real property, in accordance with Section 551.072, of the Texas Government Code.

(B) Deliberate issues regarding economic development negotiations in accordance with Section 551.087, of the Texas Government Code.

(C) Deliberate pending/ contemplated litigation, settlement offer(s), and matters concerning privileged and unprivileged client information deemed confidential by Rule 1.05 of the Texas Disciplinary Rules of Professional Conduct in accordance with Section 551.071, of the Texas Government Code.

NOTE: Commissioners Court reserves the right to retire into executive session concerning any of the items listed on this Agenda whenever it is considered necessary and legally justified under the Open Meetings Act (Chapter 551 of the Texas Government Code).
