COMMISSIONERS COURT OF COMAL COUNTY TEXAS

NOTICE is hereby given that a REGULAR meeting of COMMISSIONERS COURT will be held on Thursday, October 05, 2017 at 8:30 AM in the Commissioners Courtroom, 100 Main Plaza, New Braunfels, Texas. You may visit our website at www.co.comal.tx.us for agenda postings.

Before each regular session will be an invocation and pledges to the flags. All persons in attendance are invited to participate or not at their own personal discretion.

CALL TO ORDER:

The following subjects will be discussed, considered, and acted upon:

1. Approve Claims.

2. Proclamation Declaring National Night Out 2017.

3. Proclamation Recognizing October 1-7, 2017 as 4-H Week in Comal County.

4. Proclamation Recognizing the Sophienburg Hill with the Texas Historical Commission Subject Marker and Historic Site of the Republic of Texas Marker.

5. Proclamation Recognizing October 1-7, 2017, as Power Up at Your Library Week.

WORKSHOP AGENDA:

1. Citizens’ Comments. (Citizens’ Comments are limited to three minutes per person. Pursuant to the Texas Open Meetings Act, the Court is limited in its ability to respond to Citizens’ Comments.)

2. Reports by County Staff and Elected Officials on items of Community interest.

6. Discuss and consider approval of the Amendment to Plat of Vintage Oaks at the Vineyard, Unit 2, combining Lots 610 and 611, establishing Lot 610R. (Pct. 1)

7. Discuss and consider approval of Resolution 2017-25 pertaining to the Alamo Area Council of Governments’ (AACOG) Solid Waste Grant Application and authorize Assistant County Engineer, Robert Boyd, to act on behalf of Comal County in all matters related to the applications.

8. Discuss and consider approval of Resolution 2017-26 Nominating a Candidate for the Comal Appraisal District Board of Directors Election.

9. Discuss and consider approval of Resolutions regarding " Texans Feeding Texans" grant funding for the Texas Department of Agriculture Home-Delivered Meal Grant Program, for the period of September 1, 2017 - August 31, 2018, and authorize County Judge to sign:

A. Resolution 2017-27 certifying that the County has made a grant to the Comal County Senior Citizens Foundation, an organization that provides home-delivered meals to home-bound persons in the county who are elderly and/or have a disability and certifying that the County has approved the organization's accounting system or fiscal agent; and

B. Resolution 2017-28 certifying that the County has made a grant to the Community Council of South Central Texas, an organization that provides home-delivered meals to home-bound persons in the county who are elderly and/or have a disability and certifying that the County has approved the organization's accounting system or fiscal agent.

10.Discuss and consider approval of Fiscal Year 2018 Certified Local Government Subgrant between Comal County and the Texas Historical Commission, and authorize County Judge to sign.

11.Discuss and consider approval of Amendment to PayPal Here Agreement, Paypal Website Payments Pro/Virtual Terminal Agreement and PayPal User Agreement (Pricing Amendment), and authorize County Judge to sign.

12.Discuss and consider approval of Interlocal Cooperation Agreement between Comal County and the City of Spring Branch for Law Enforcement Services, and authorize County Judge to sign.

13.Discuss and consider approval of Interlocal Cooperation Agreement between Comal County and the City of Spring Branch for Animal Control Services, and authorize County Judge to sign.

14.Discuss and consider approval of a line-item transfer in Contract Services, FROM: Community Council of South Central Texas, TO: Comal County Senior Citizens' Foundation to re-allocate budgeted funds based on individuals served.

15.Discuss and consider approval of a line-item transfer in County Court at Law #2, FROM: Special Investigator, TO: Continuing Education/Travel to provide funds for reimbursement of conference expenses for court reporter.

16.Discuss and consider approval of a line-item transfer in Road and Bridge, FROM: Road Construction and Maintenance, Computer Components & Software and Parts and Repairs, TO: Traffic Control Devices, Contract Services, Computer Components & Software, Capital Equipment and Non-Capital Equipment to provide funds for equipment purchases and expenditures for remainder of 2017.

17.Discuss and consider approval of purchase of printer and toner for Justice of the Peace Pct. 4 utilizing the Justice Court Technology Fund.

18.Discuss and consider approval of the creation of the Comal County Operational Policy Committee.

19. EXECUTIVE SESSIONS:

In accordance with Chapter 551 of the Texas Government Code, Subchapter D, Commissioners Court may convene in a closed session to discuss any of the following items; any final action or vote taken will be in public.

(A) Deliberate and consider the purchase, exchange, lease or value of real property, in accordance with Section 551.072, of the Texas Government Code.

(B) Deliberate issues regarding economic development negotiations in accordance with Section 551.087, of the Texas Government Code.

(C) Deliberate pending/ contemplated litigation, settlement offer(s), and matters concerning privileged and unprivileged client information deemed confidential by Rule 1.05 of the Texas Disciplinary Rules of Professional Conduct in accordance with Section 551.071, of the Texas Government Code.

NOTE: Commissioners Court reserves the right to retire into executive session concerning any of the items listed on this Agenda whenever it is considered necessary and legally justified under the Open Meetings Act (Chapter 551 of the Texas Government Code).
