NOTICE is hereby given that a REGULAR meeting of COMMISSIONERS COURT will be held on Thursday, April 19, 2018 at 8:30 AM in the Commissioners Courtroom, 100 Main Plaza, New Braunfels, Texas. You may visit our website at for agenda postings.

Before each regular session will be an invocation and pledges to the flags. All persons in attendance are invited to participate or not at their own personal discretion.



The following subjects will be discussed, considered, and acted upon:

1. Approve Claims.

2. Proclamation Recognizing Inclusion of Walzem Homestead in the National Register of Historic Places.

3. Proclamation Recognizing Haag Cemetery as a Texas Historical Commission Historic Texas Cemetery.


1. Citizens’ Comments. (Citizens’ Comments are limited to three minutes per person. Pursuant to the Texas Open Meetings Act, the Court is limited in its ability to respond to Citizens’ Comments.)

2. Presentation by the Texas Association of County Engineers and Road Administrators (TACERA) recognizing Tom Hornseth as Engineer of the Year.

3. Reports by County Staff and Elected Officials on items of Community interest.


4. Discuss and consider acceptance of Construction Bond No. 1155211 as surety for road construction and other site improvements within the proposed subdivision of The Crossings at Havenwood, Unit 4, and authorize County Judge to sign said surety bond. (Pct. 3)

5. Discuss and consider approval of the Amendment to Plat of Mystic Shores, Unit Eleven, combining Lots 1364 and 1365, establishing Lot 1364R. (Pct. 4)

6. Discuss and consider ratifying License Agreement between Comal County and Sattler Estates Property Owners Association, on FEMA property located at 1296 Ponderosa Drive, New Braunfels, Texas 78132.

7. Discuss and consider approval of Agreement for Provision of Economic Development Services with The Bulverde/Spring Branch Economic Development Foundation, Inc. and authorize County Judge to sign.

8. Discuss and consider approval of Medicare Enrollment Application CMS-855B for Comal County Public Health Department and authorize County Judge to sign.

9. Discuss and consider approval of updates to the Comal County Cell Phone Allowance Policy.

10. Discuss and consider approval of the following changes to the Water Oriented Recreation District of Comal County Board of Directors:

(A) Accept resignation of Jennifer Robinson effective February 3, 2018; and

(B) Appoint Jean Robinson to fill unexpired term of Jennifer Robinson.

11. Discuss and consider approval of selection of Construction Manager-at-Risk for 2018-3300 Landa and Annex Buildings Renovation and authorize the Purchasing Director to negotiate the contract.

12. Present and consider award of Bid 2018-1023 Flexible Base Type A Grade 1 and authorize Purchasing Director to execute all related documents.

13. Present and consider award of Bid 2018-1104 Riprap Stone, Gabions, Gabion Mattresses and authorize Purchasing Director to execute all related documents.

14. Discuss and consider approval of a line item transfer FROM: Administrative Costs-Contingency, TO: Recycling-Disposal Costs and Recycling-Contract Services to cover increased anticipated costs for disposal and mulching 2018.


In accordance with Chapter 551 of the Texas Government Code, Subchapter D, Commissioners Court may convene in a closed session to discuss any of the following items; any final action or vote taken will be in public.

(A) Deliberate and consider the purchase, exchange, lease or value of real property, in accordance with Section 551.072, of the Texas Government Code.

(B) Deliberate issues regarding economic development negotiations in accordance with Section 551.087, of the Texas Government Code.

(C) Deliberate pending/ contemplated litigation, settlement offer(s), and matters concerning privileged and unprivileged client information deemed confidential by Rule 1.05 of the Texas Disciplinary Rules of Professional Conduct in accordance with Section 551.071, of the Texas Government Code.

NOTE: Commissioners Court reserves the right to retire into executive session concerning any of the items listed on this Agenda whenever it is considered necessary and legally justified under the Open Meetings Act (Chapter 551 of the Texas Government Code).
